Guilty: DUI, No Seatbelt, Resisting Arrest

Yesterday morning [Nov.15] 36-year-old Brian Gibbons pleaded guilty to five charges. One of driving whilst impaired, two counts of having no driver’s license, one count of failing to wear a seatbelt, and one of violently resisting arrest.

Initially Mr Gibbons pleaded not guilty to the charge of violently resisting arrest. However after he had heard the summary of evidence read out in connection with the driving whilst impaired offence, he changed his plea, on that matter, to guilty.

The offences of driving whilst impaired and of violently resisting arrest occurred on 14th November 2011 on Somerset Road.

The DPP’s evidence was that Police in a patrolling vehicle had seen Mr Gibbon’s car veer across, come back on the correct side and then plow into a roadside hedge.

On approaching him and inquiring, Mr Gibbons was said to have replied: “I’m just trying to get some p—y.”

On checking, Police learned that Mr Gibbons also had outstanding warrants. When they attempted to get him out of the car, Mr Gibbons pulled his hands away and took a swing at the female officer. He missed but he attempted to escape.

He had to be subdued and two applications of Captor spray were required before he could be handcuffed.

Magistrate Warner fined Mr Gibbons $1,000 for driving whilst impaired, $500 for violently resisting arrest, and $100 each for each of the remaining three counts. Mr Gibbons was also disqualified from driving all vehicles for twelve months.

    Oh, I don’t see the same public outcry here compared to when a similar incident happened involving an expat. Where are those people that claimed, if it was a Bermudian in a similar situation as Matthew Marshall, that individual would be in Westgate? Mr. Gibbons had outstanding warrants and still received a lesser fine than the expat. Was it that his excuse of “trying to get some p—y” was more believable?

        Lol! I think the police did that woman a favour! I do hear that Mr. Marshall may have lost his job. I wonder if Mr. Gibbons will lose his but I doubt it. Double standards all around.
