Edness Fined $1150 For DUI, Traffic Offences

Currently serving out a prison sentence that was handed down last year, Prince Edness, 26, was asked this morning [Jan 15] by Senior Magistrate Archie Warner why he had failed to appear in Magistrates Court on 14th November 2012 to face three charges.

Edness explained that on that date he was incarcerated, saying that he had been in jail at that time. Accepting this explanation, the Senior Magistrate put the three charges to Edness.

All related to a Police intervention on Front Street in September 2012. The charges were: driving whilst impaired; having no driver’s licence; and riding an unlicensed cycle. Edness pleaded guilty to all three.

Magistrate Warner fined him $1,150 total for the three offences with the alternative of spending up to 115 days in jail if the fines were not paid.

Edness pleaded not guilty to a fourth charge of riding a bike while the bike was not covered by a third party insurance policy. He said that if he was allowed to make appropriate contacts, he would be able to prove that the bike had been insured at the time. The Magistrate set the matter down for a later re-appearance in Court.

    Clearly this Magistrate needs to retire- WHY would he set “THIS MATTER,” down for a later re-appearance in Court??? I can NOT believe this man (the Magistrate) has been allowed to STAY on the bench with his blatant disregard to appropriate sentences. The police officer who stopped Mr. Edness clearly had to prove the bike was unlicensed before that charge was made!

      That wasnt the charge. The charge was uninsured and you can get your vehicles insured and not license them and unfortunately the insurance companies are not linked with TCD.If at the time of the officer giving you a ticket you dont have your ins papers on you proving that your vehicle is insured and your vehicle is unlicensed then there is no way of telling if the person hasnt been to TCD. However, if the person takes the ins papers to court with them proving the vehicle was ins at the time the ticket was written then the person is considered not guilty for that offence. Hope this clears up the misconception.

        INCORRECT because of the forementioned behaviour of some drivers INSURANCE COMPANIES DO WORK with TCD and will NOT license your vehicle if it has NOT been TRANSFER TESTED!!! ATt least this is the policy with my INSURANCE COMPANY – COLONIAL and it is ALSO their policy to INFORM POLICY HOLDERS of this FACT!!!

          What do you mean incorrect what stops me from letting my vehicle expire go to the insurance company insure it but just never go and license it. My point is unless the person goes to TCD its no telling whether the vehicle is insured or not. Just so you know unlicensed and uninsured are two seperate tickets.

    Car – Bike – I pad – I pod – Stereo System – TV – or anything of worth to make up the fine.
    If he gets sent him to Prison than we pay. – and why should we the people pay for this guys offence.

    This Magistrature need to retire – go. The park-side rats are always getting off easy. I hope his extra 115 days are consecutive to his present sentence, but with our ” I didn;t know he was a gang member Parole Board” the 115 days may not count onto his sentence. He knows why he pleaded guilty and not waste courts time.
