Man Sentenced To 3 Days In Jail For Stealing
A 43-year-old man was sent to jail for three days after pleading guilty to stealing approximately $54 worth of food and detergent from a supermarket.
David Ray appeared in Magistrates Court this morning [Apr 5] where he initially pleaded not guilty to stealing $54 worth of products from Somer’s Supermart in St George’s.
After taking advice from the Duty Counsel, he changed his plea to guilty. Mr Ray was convicted and sentenced to three days in prison.
The prosecutor told Senior Magistrate Archie Warner that Mr Ray had been seen filling a bag with food items such as sausages, sugar, patties, yogurt, and had left the store without paying. He was accosted outside the store, police were called, and he admitted to the theft.
The Duty Counsel told the Magistrate that, at that time, Mr Ray was unemployed and that all the items stolen were either food items or items for use in maintaining his personal cleanliness. The lawyer also pointed out that Mr Ray intended to make restitution but could only do after he had completed a prison sentence that he was currently serving.
Magistrate Warner ruled that Mr Ray’s sentence for this offence would be three days in prison and that he must make restitution of $54.19 to Somers Supermart.
The Magistrate also ruled that the three day sentence was to run concurrent with the time currently being served by Mr Ray for non-payment of outstanding fines. At today’s court hearing, Mr Ray said that he had four more days to serve to complete that default time.

For this type of matter, is there a possibility that a defendant is required to make restitution for his theft, rather than lock him up for a 3 day holiday and absolve him of any responsibility?
Re-read the passage Ms. Smith. “Magistrate Warner ruled that Mr Ray’s sentence for this offence would be three days in prison AND that he must make restitution of $54.19 to Somers Supermart.” The punishment is fitting of the crime.

Question to whomever – Being he has to make restitution to the shop, was he allowed to keep the stolen items. If they were confiscated from him, then he should not have to pay for them.

in cases where people are stealing things they need, why dont we let them have it if they really cannot pay?

I’m quite sure if he was genuinely hungry and in need of food and other help,the local Salvation Army Captain would have assisted.
I find this to be completely retarded. Seriously what are 3 days going to do to him?? he should be made to do some community service or something to work off the amount stolen and then some!!

If all read the article correctly they’d noticed that he is already in jail and the sentence will not cost the public any thing beause, his sentence will run concurrently with the jail term he was serving when he stole from the Somer….I know, how stupid can one be?
