23 Yr Old Man Denies Infecting Woman With HIV

In Magistrates Court this morning [Nov 19] a 23 year old man was charged with having sexual intercourse with a woman without telling her he was HIV positive.

The charge was that he sexually assaulted the 20 year old woman by having sexual intercourse with her without telling her he had HIV.

They both have tested positive for HIV, and the Court heard the couple are still in a relationship.

The man pleaded not guilty, and was remanded into custody by Senior Magistrate Archie Warner until his trial date of 25th November 2013.

Due to the charge being sexual assault, the defendant cannot legally be named at this stage of the proceedings.

    The couple are still in a relationship!! They might as well shiddd!! But on a serious note this is really sad and i feel for the girl cause he is someone she is supposed to trust but on the other hand its tons of protection out there. It would be nice to name him so other females he has had sexual contact with that are unaware can get tested but at the same time this puts the young lady at the risk of being shamed. This is an all around sad situation.

          Having worked in the clinic. .. there is no need to publicly announce his name. When someone is found to have an STD or STI, especially HIV there is process done called contact tracing. With contact tracing the positive individual MUST supply ALL the names of anyone he/she has been in sexual contact with. The individual (s) will be contacted and tested as well.

          This contact tracing procedure is completed in all testing centers.

          If this gentleman has been sexually active with other females the females have been or are probably in the process of being contacted. However, she will not be told who may or may not have spread infection to her. Due to patient confidentiality agreement.

          I agree and understand BUT then its not just a slight issue; its a life conflict. And most are ashamed of it and won’t tell others. So its harsh but it’s worth being protected; even if it causes shame.

                It is no longer a death sentence; it is a condition that can be managed. If I loved her then that would be a choice I would have to make on the facts. There are relationships that function quite normally where one party has a transferable disease.

                I was commenting that a suggestion that the victim is now worthless to anyone else so she may as well stick with the guy as ignorance.

    A man allegedly infects you with HIV without having the decency to tell you he’s infected and you stay with him???

    She may feel that no-one else wants her but, sorry-there’s no way I stay with a man after he allegedly hid such a life changing detail from me. It says a lot about his overall character. He should have been honest in the beginning and she may have still decided to go ahead with the relationship but it should have been her choice.

    Also, infected at 23? God, that’s so young. I have an eighteen-year-old daughter and this kind of stuff scares the daylights out of me.

There is no reason why you should pursue a criminal matter against the boy, and then continue pursuing a relationship thereafter. That only supports the idea that she has consented the act. Therefore, why are they in court? So you are right…Let them live their lives together.

        Many females are in unhealthy relationships (no pun intended) with men that abuse them verbally, physically and mentally. Many women fall in love and marry murders in jail each year. Who knows why they are still together. Maybe she is in love with him and they are happy together. However, that does not make what he is charged with any less of a crime, and that is why he is in court. If he was speeding and intoxicated in a car with her in it, crashed the car causing her to die, would you say he shouldn’t be prosecuted because he was also injured or because they were in love??? Think about what you are saying?!

    Relevant section of the criminal code:
    (1) It is a sexual assault if a person—

    (a) knowing that he has a sexual disease, does a sexual act which—

    (i) involves contact between any part of his body and any part of the body
    of another person (whether or not that other person is his spouse or
    consents to the act); and

    (ii) is capable of resulting in the transfer of body fluids to that other person;
    and

    (b) before he does the act does not inform that other person that he has the
    disease, either identifying the disease or making clear to that other person
    that he has a disease to which section 324 of the Criminal Code applies.

      Although the Criminal Code makes this an offense and since I have not read the Code itself, maybe it should be mandatory that the accused provide the name(s) of any other persons they have been sexually involved with so that authorities (perhaps his or her physician)will notify those individuals to advise them that if they have not been tested, perhaps they should be.

    This is very unfortunate for these young people to be living with HIV but there are medications that will pronlong their lives…Parents need to encourage and teach their children to protect themselves, You cant blame anyone in this situation…. and she does love him to continue a relationship with him…. I am very sure that they are not the only young adults who have this decease If you read the health statistics its very high between 16-28 with HIV in Bermuda……All we can do is pray for them both and everyone else living with this dreadful Virus..

    Why are people concerned with revealing names so their other partners can get tested…. their other partners should be getting tested on a regular basis if they are engaging in unprotected sex. This is 2013 and it is widely encouraged to get regular std test done. It is very sad that they are so young but let this be a reminder to the youth of Bermuda that no one is immune to it. Parents, if your children are sexually active then get them tested annually…you don’t know what goes on when you’re not there.

    I don’t necessarily think it’s ethical to name the people as there might be some kind of doctor-patient confidentiality or something like that. So that could be a potential reason as to why he is not being named.

    However, this is a great example of the importance of STD testing! People are sometimes under the impression that things like this will not happen to them and then they unfortunately do.

    No, their names should be confidential. It is their problem and they are the ones who have to live with it and should be able to do so without having to also endure the stigma attached. Particularly for the young woman – by exposing his name, we know who she is. Each individual IN ANY EVENT should be practising safe sex and ensuring that their partner is safe. You shouldn’t rely on the courts or a newspaper or media outlet to tell you who is HIV positive. IT IS YOUR RESPONSBILITY.

    They shouldn’t have to be named. That’s why they tell you and is smart that you and whoever your having a sexual relation with should get tested before and throught out your relationship. You shouldn’t sit around and wait until you see/hear that one of your previous partners have been tested positive for anything, to go and get tested.

    THIS IS EASY.May I suggest if you are going to have a sexual relationship just ask the other party too have a blood test.
    This will tale care of HIV and Sif both are killers if not tended to.
    The rest of the STD’s will have to be on a truthfull conversation basis,
    as some there is no CURE for.
    It is your body and it is your health,YOU have to be PRO-ACTIVE.

    The biggest lesson here is to get tested BEFORE engaging in unprotected sex. Had they done that, she would have been faced with a totally different set of circumstances. We all need reminding that it’s our own responsibility to be safe when engaging in sexual activity.

    But no where in the article does it state he knew he had HIV, only says they both have now tested positive. Seems like an important fact to know considering the allegations. And how is that proven in court without violating his medical privacy? If others can testify they knew he had HIV then why didn’t the woman he was in a relationship with know it?

HIV is the virus that infects a person. AIDS is the disease that later develops in people with HIV. AIDS, is really an acronym for “as i die slowly”. People have got to do better then this man.   32. Just putting this out there…. Has anyone thought where the young man contracted this desease from? I would assume that it was transferred to him by another partner he may have had in the past. Would you maybe think that he should have that individual that gave hime his sentence prosecuted also? I think they should. Why not bring them all to court and find out if they all knew before they had relations with the next partner? Do you know how many people would be in court? Standing room only… Never the less, their names not be exposed. I agree with most when they write that each is responsible for themselves. When you make a choice, be prepared to accept the consequences, good or bad. You are responsible for yourself.
