Opposition Leader Seeks Censure Of 2 MPs

Yesterday [May 30] in the House of Assembly, Opposition Leader Marc Bean gave notice that he intended to move a motion next week asking for Tourism Minister Shawn Crockwell and former Attorney-General Mark Pettingill to be censured for their role in the “JetGate” affair.

Mr. Bean said they “failed to respect the Ministerial Code of Conduct and failed to apprehend or acknowledge the seriousness and or gravity of their acts and omissions for breaching the Ministerial Code of Conduct.”

The full statement from Mr. Bean

I give notice that at the next day of Meeting, I will Move the following Motion:-

That this Honourable House censures the Member for Southampton West Central, the Hon. Shawn Crockwell, JP, MP and the Member for Warwick North East, the Hon. Mark J. Pettingill, JP, MP.

(a)
Having had responsibility as Ministers, as Attorney General in the case of the Member from Warwick North East, and as the Minister of Tourism and Transport in the case of the Member for Southampton West Central, failed to respect the Ministerial Code of Conduct and failed to apprehend or acknowledge the seriousness and or gravity of their acts and omissions for breaching the Ministerial Code of Conduct, in two material particulars, namely; Code V by failing to give accurate and truthful information to Parliament in connection with a private flight to Washington D.C. on March 20th. 2013 the purpose of which said flight was to provide air transport to Washington DC in order to meet with a potential hotel and casino developer, and Code XVII, accepting the following favours, namely free air transportation and hotel accommodation from an individual(s) who are in negotiations with or seeking to enter into contractual or proprietary or pecuniary relations with the Government of Bermuda.

(b)
Failed, as elected Members of the Legislature, to inform this Honourable House of the full nature and extent of their involvement in connection with the above trip at the earliest opportunity, in particular, failed to inform this Honourable House fully as to the involvement of a private citizen on both the flight on March 20th 2013 and the subsequent meeting in Washington D.C. on March 21st.2013 and, in so doing, contributed to the Honourable House being misled on the details of the said flight and said meeting on March 21st 2013 in Washington D.C.

(c)
Failing to appreciate, apprehend or grasp the level of public disquiet that has arisen as a result of their failures in (b) above.

(d)
Following the resignation of the Member for Devonshire South Central as Premier, further failing to apprehend public disquiet over the said events and their involvement, and in the case of the Member from Southampton West Central, failing to tender his resignation as Minister as a result of the above.

(e)
In the case of the Member for Warwick North East, for the role he played in advising the former Premier that the said flight and meeting in Washington would not constitute a breach of the Ministerial Code cited in (a) above, and for continuing to so assert publicly, following the resignation of the Member of Devonshire South Central as Premier.

        No we would be more “comfortable” if he was consistent in his actions.

        He has spent one year arguing over something that has not cost the people of Bermuda $1. However, he does not seem to have an issue with any of the past 14 years and millions wasted and $800 million “unaccounted” for.

        Fortunately, the people of Bermuda are smarter and know that these a re tactics of a man who is trying to cause diversion and divisiveness in order to distract the OBA from being able to uncover that wrong doing of the last 14 years.

            Ian – seriously. There are $800 million that are unaccounted for. That is not a rumour – that is a fact that was disclosed DURING the PLPs time in government.

            If $800 million is “unaccounted for” how would you explain it. The way most people see it is:

            a) stolen or “gifted” to friends and family.
            b) total incompetence by the PLP government if they don’t know where it went?

            I will let you pick or come up with your answer. Somehow, I doubt you will.

            I will let you explain the difference between the two parties thusfar.

            Lets see the first thing the PLP did when they came into power was have a National Holiday. Cost to the people of Bermuda was estimated at over $4 million dollars in civil servant wages and more. OBA went straight to work.

            $0 missing from public purse under OBA so far.
            $800 Million unaccounted for under PLP rule or approximately $4.6 million per month over a 14 year period.

            Lets see, $4 + ($4.75 million x 18)$85.5 million = $89.5 million saved already.

          Who resigned over Tuckers Point SDO? – Why should someone have resigned over Tuckers point.

        “Premier Ewart Brown suffered a crushing blow yesterday as his cruise ship gaming bill failed with seven Progressive Labour Party MPs voting against it.

        Dr. Brown shocked the House of Assembly by attempting to push the legislation through without rebel or Opposition MPs knowing — despite pledging the day before to put it on the back burner until November at the earliest.”

        Aren’t hypocrisy and fake indignation sufficient reasons for Mr. Bean to resign his position or at least self censure?

          I’m not sure your reference is an apples to apples comparison with the events of recent past on the OBA’s part. It doesn’t help when you take absolutely no issue whatsoever with said recent scandal. It also doesn’t help your position when the best you can do in acknowledging your parties behavior is making reference to your account of past PLP actions… Is there an established time after which that carries no weight our are you guys going to do that going into the next 5, 15, 5o years?! As for the little mantra you’ve ended on, how many OBA/UBP supporters put themselves in a ton of debt thinking the good times would never end b4 2oo8 – while the PLP was in power? What exactly did the UBP do to improve education on the island for the folks you profile as undereducated PLP supporters? Recall it was the UBP that shut down the very successful Tech Institute and built that monstrosity Cedar Bridge. And as Ive asked you before the last time you dropped that line, what exactly are your credentials my educated, employed, debt free, OBA supporting brethren?

        I’d be more comfortable if he didn’t think we should breath in everything he say a being an aromatic truth that he and his party embody and live by, when he is talking out his backside. Bermuda deserve more from an opposition leader/party, other than one that is only out to win the next election through a 5 year smear campaign. Every time he puts this load of BS forward in the house, it is taking away from the time that the government as a whole body could be working to fix this country. There are really very few reasons that keep me from supporting the PLP, but the biggest has to do with the fact that they inflict the mentality of party before country, mostly because they see themselves as being the country as opposed to being a part of it. You do not have to be PLP to be black or Bermudian, you just have to care more about what a person does than by what he says, and after 14 years, what Mr. Bean says does not match with what they’ve done, or what I would trust them to do. Mr. Bean has yet to show anything otherwise and that is why he is failing, the PLP and the country as a whole.

      Whatever the PLP did is the reason why they are no longer government. Also, whatever the PLP did cannot be used as an excuse to accept, allow, or defend the wrongdoing from this government or any government minister.

      The question is – did they break any part of the Ministerial Code of Conduct?

      (v) It is of paramount importance that Ministers give accurate and truthful information to Parliament, correcting any inadvertent errors at the earliest opportunity. Ministers who knowingly mislead Parliament will be expected to offer their resignations to the Premier.

      Take time to go back and read over the Jetgate events , bernews has a great timeline which you can easily follow, and ask yourself did those involved ” knowingly mislead Parliament.”

      (ix) Ministers should not accept any gifts or offers of hospitality which might, or might reasonably appear to, compromise their judgment or place them under an improper obligation.

      Did those involved accept gifts or offers of hospitality? Luxury plane ride and paid for overnight stay can be considered to be a gift or offer of hospitality.

      (xvii) Ministers should not seek or accept any kind of favour from individuals who are in negotiation with, or seeking to enter into contractual or proprietary or pecuniary relations with the Government.

      Was Mr. Landow seeking to enter into contractual or proprietary or pecuniary relations with the Government via his interest in the Club Med site?

      Answer this question please, some OBA member who accepts this behaviour.

      Why did the former Premier have to resign, even facing pressure from his own party to resign, and not the others involved when they did the exact same thing?

        Ian. In case you haven’t noticed, people “in the OBA camp” are just really anti PLP. These taxpaying citizens, myself included are hardworking, Bermuda loving, people and yes, we’re pissed off. That’s right, we’re all incredibly pissed off. We had to watch while the PLP ruined the country’s finances, possibly forever, while the PLP split the psyche of this country into black and white, possiibly forever, bloated th civil service and created a sense of entitlement that will be all but impossible to fix. So if you thnk we’re just going to sit back and watch the PLP continue to ruin this place, your wrong, very wrong.       Marc Bean has previously accepted and acknowledged the wrongdoings, failings, and faults of his party when they were government. From your list, which one is Mr. Bean responsible for?

      MINISTERIAL CODE OF CONDUCT is the focus of this motion of censure.

      What is your honest view of these allegations and not using the the irrelevancy of what the PLP did when they were government?

      Was “jetgate” a stupid move on the part of those that were involved? Undoubtedly. Was it fraud? No. Bribery? No – however, if this had resulted in a big $$ contract to Mr Landow, perhaps. But that is not what happened. Corruption? No. Misappropriation of public funds? No. Should the OBA had been more forthcoming with info about this? Yes.

      Mr Bean has succeeded in getting the resignations of the Cannon (who I personally think was a bit weak as a leader, but a good person overall. I’d trust him over Beanbag any day of the week) and Pettingill (who I think is a ##$#). Is that not enough? Crockwell is a minor player. i don’t even think OBA supporters care one way or the other about him. What is the point of censure anyway? It’s not like anything meaningful will come out of it.

      The important things are getting Bermudians back to work and getting the economy back on track. Smoke and mirrors are fun to play with but they sure ain’t going to help us at the end of the day… PLEASE can we deal with important issues now.

    This entire situation is very interesting to say the least. It was the opposition leader’s constant badgering that actually resulted in the resignation of both the former Premier and the Attorney General; If not ‘resulted in’, at a minimum ‘contributed to’. Neither looks good for the country as a whole, but it wasn’t Mark Bean who did the dumb deeds, it was the former Premier and former Attorney General! That said, what appears to be a small victory to the Opposition has actually resulted in the former ‘establishment’ ie. Michael Dunkley and Trevor Moniz, ex UBP MP’s both being placed in the highest and most powerful roles in government! I don’t know if that’s what the Opposyion leader anticipated… But.. All so very interesting indeed. The complete story remains yet to be told! Stay tuned.

      logic may dictate that having the unelectable former ‘establishment’ in prominent roles may now make the OBA unelectable moving forward

      my only advise to Bean would be after the jetgate affair has run its course start the process of transiting from an opposition leader to a potential government leader

      Bean’s political future is in his own hands and the OBA’s is now out of theirs

    All of you supporting MB right now are a part of that COG in the wheel that has now prevented Bermuda to go forward. Nobody from the opposition should complain one smidgen of an ounce. All were sitting still in their HIGH CHAIRS being fed their baby koolaid juice while their previous government led us on the fast track to economic HELL. Never really thinking of Bermuda best, but just thinking of lining their pockets with Bermuda’s $’s in not illegal ways but unethical ways.
    Not one ounce of Bermuda taxpayers dollars was spent on that trip. I believe it was a mistake to take such a trip knowing that the awaiting PLP VULTURES are watching their every move and are ready to pick apart everything they do and put forward. OBA should have known that and should have been prepared.
    So MB and all the PLP supporters should be biting their lips and tongues in silence for now. It seems to me that the OBA have one shot at cleaning up the stench and mess that the PLP left behind. All PLP members should know of how this country was left in economic ruins when they left power, and still had not even a shred of a clue on how to get Bermuda out of their black hole they created. If the PLP supporters do not see that, and the OBA fail ( due to the PLP tactics ) then we will never progress.
    Time for them to SHUT THEIR FRONT DOORS, and use some real knowledge on uniting Bermuda to be that shining gem in the ATLANTIC once again.
