31 Yr Old Admits Running Across Beach Naked

A 31-year-old man appeared in Magistrates Court today [Aug 4] where admitted running naked across a beach in Sandys parish during the first day of Cup Match, with the Court hearing this happened after he lost a bet, and that alcohol was involved.

Thomas Moroney pleaded guilty to the offence, which occurred on Somerset Long Bay on 31st July 2014. The Court heard that Mr. Moroney — said to be a guest worker –  had told police that he had done the act as a result of losing a bet.

Senior Magistrate Archie Warner said that Mr. Moroney’s act of running across the beach with, as the Crown Prosecutor described it, a drink in one hand and a certain part of his anatomy in the other, was an act of drunkenness and stupidity.

The Magistrate said that there was no evidence of any sexual or predatory behavior, noted that Mr. Moroney had no prior convictions of any kind, and handed down a Discharge while advising Mr Moroney that “perhaps you should stop drinking”.

Mr. Moroney apologised to the Court, and expressed his embarrassment over the matter.

        It’s all innocent fun. If you want to go after the predators then fine, but we live on an island for goodness sake. Go to non- mariners now. A lot of the bikinis, if you can call them that are indecent but people go to these events just to see what crazy things people do. There have been plenty of events on the island, mind you they have been night time events, that encourages and often gives prizes for people to get naked. Bermuda needs to loosen up.

          Why weren’t the young ladies that had on thong swimsuits arrested for indecent exposure. There were plenty of little children at horseshoe bay beach, and young ladies in thong swimwear.

    Not Surprise let that be a Bermudian they would have gotten a custodial sentence and have to register as a sex offender. WOW my Bermuda have gone to the S*&%&TS.

      And……there have been PLENTY of Bermudians that were ACTUAL sex offenders that have either avoided jail completely or received ridiculously lenient sentences for much more serious offenses.

          Not according to Kim Wilson when she was AG. She said the law does not allow for a SE registry. That was in July 2012. I don’t recall anything being set up since.
          Not that it’s relevant in this case, by any means.

            You are confusing two things. There IS a registry, just not a public one. The law, as it stands, does not allow for a public registry.

            As an aside, public sex registries have been found to be largely ineffective and counterproductive.

          And so he should. There’s a huge difference between running along a beach naked and deliberately pulling down a lady’s bikini bottom for all to see. While I accept that the first is indecent exposure, the second is possibly within the area of an indecent assault.

      That’s a load, ‘if this had been a Bermudian’ with the same conditions, would have gotten the same. They looking up how the courts have treated guest workers in comparison. We have had Bermudians involved in drunk driving deaths get off with fines and off the road, while foreign workers have gone to jail or been given suspended sentences. I am sure that if he had done this at somewhere like Horseshoe, and had it not been the Cup Match holiday, he would have been fined at the least. Course it would have depended what judge they need up in front of too.

          @sickofantz-Exactly, I remember when a certain Dentists’ son rode his bike down front street naked….he did get stopped by the police, but at the time we all thought it was awesome!
          Also I know of someone else who humped the statue of Jonny Barns while in his knickers (not quite naked), but that doesn’t mean he should be on a sex offender registery….it just means he had a wild night, and prob a really bad headache the next day!

    I had someone stand in my yard and urinate. There were children in the yard so hee was charged with indecent exposure and was not given conditional discharge. There was no evidence of sexual or predatory behaviour either. Only difference he was a Bermudian.

      Don’t suppose the fact that he came onto private property with intent to violate it. Someone urinating in someone else’s yard is a slightly different a set of circumstances, from a drunk idiot streaking across a beach, who, as reported, was trying to maintain some modesty by covering what he could with one hand. Did the person who use your yard as his toilet have a previous background of similar offences? Bermudian/not-Bermudian, you seem intent on ignoring that foreigners tend to get worse treatment in the courts than Bermudians for major crimes like drunk driving.

      I am not defending the idiots actions, I think he should have gotten some small fine at the least, and I know there are those out there who would comment about ‘and if you had children at that beach’, I would have simply looked at my children and said, “this is why you should always drink responsibly, if you don’t you will invariably end up doing something stupid that will haunt you for the rest of your days.”

    I’m guessing the conditional discharge would state he can’t be arrest for anything in the next x days or he will have to go to jail for x days.

    I honestly would have thought they would have fined him as well. I guess the fact he doesn’t have a record or tried to grope anyone but himself help as well. Still I agree if he was Bermudian I wouldnt be surprised to seen ‘at least’ a fine or worse.

      You cant really blame them though because look at the backlash they got from imprisoning certain folk. An example would be that woman who slashed the other woman in the face. Everyone knew it was a joke as he was not lerking in the trees or walking around with a erection. He had a drink in one hand and his well….in the other, we all thought is was small matters really.

    The courts are setting a pattern here . A white Bermudian of Portuguese descent caught with a substantial quantity of drugs , no case to answer ,walks out of court onto a flight to America , never to be heard from again . A white expat runs naked across a beach packed with families , goes to court and tells the judge ” I lost a drunken bet ” , ” I had a drink in one hand and a bat with two balls in the other , come on it was Cup Match “! . Needless to say , because the drink was drunk and the arresting officer could find no evidence of the offending bat and two balls , the judge gave him a conditional discharge despite his self incriminating statement .

    Amazing how complaints invariably fly around about race even when the magistrate – and the Senior Magistrate at that – happens to be black. We have an abundance of judicial experts in Bermuda who constantly whine and complain about sentences either being too lenient or too harsh, and often basing their opinions on their own biases and prejudices, and that applies to both blacks and whites.

    I remember the case of a black lady walking completely naked down McGall’s Hill one night who was arrested by the police, and never taken before the court because she had been drinking heavily and the police in their wisdom decided she had no guilty intent. Where exactly does that scenario fit into the racial allegations being hurled around?

    How on earth can people defend this man? I’m all for having a bit of fun, but when your so called “fun” encroaches on the rights of others then it is no longer funny. When I say rights, I have the right to peaceful enjoyment at the beach without seeing all of that. I have two young daughters, and its ridiculous that I should have to use a naked man as an example of why one should stay away from alcohol.
    The reason this turns into a racial issue is that people get disgusted when the rules don’t seem to apply equally. The rugby classic is a prime example. When those guys come here and act up, it always amazes me how many people defend it as just the good ole boys having a great time. Let a black Bermudian male do the same thing and people want them locked up forever.
    Ok, he lost a bet and streaked across the beach. You all think this is just fine, but where do we draw the line? I know for an absolute FACT that if a black man lost a bet, and was running through Fairylands or Tucker’s Town or the country club or the yacht club any other place where large number of whites congregate it wouldn’t be quite so funny. Let a naked, black man walk across Saltus or BHS where your children can see him, you would NOT say, “Ah, don’t worry honey. He’s just drunk so let me be a lesson not to drink too much alcohol.” I would bet on it!

      But you should be willing to explain the situation to your daughters anyway.

      Everyone should feel entitled ‘to peaceful enjoyment’, but you can’t control every situation that comes up. You may come across a car crash, or someone having a heart attack. It may not be pleasant to witness (at varying degrees), but if anyone’s going to explain the hows and whys, if may as well be the parents.

      Asking for people to get locked up or deported for non-criminal activity is probably over the top.

    For someone who was there with 3 children that turned and said “mommy can we do that too?”. a little 4 year old girl that had to be explained that private parts should not be out for the public to see and wake up last night in the middle of the night recalling the entire incident.

    I really don’t understand how people can take this so lightly. i get that he was drunk and more than likely he regrets his actions but for someone to defend his actions and down play them when i have had to deal with the direct effects on my children makes me very upset.

    It is not a “if he was Bermudian” thing or “he only got off because he was not from bermuda” thing. It is a simple issue of what is appropriate and what is not. That was simply not appropriate point blank period.
