PATI Information Statement

Name of Public Authority: Ministry of Legal Affairs and Constitutional Reform

Introduction:

The following information is made available under the Public Access to Information Act 2010 [PATI/the Act]. The Act grants the Bermuda public the right to obtain access to information held by public authorities to the greatest extent possible, subject to exceptions that are in the public interest or for the protection of the rights of others.

PATI is designed to increase transparency with regard to the activities of public authorities and their decision-making processes and to hold such authorities to a high standard of accountability. Each public authority is required by law to publish an information statement describing the organization and functions, the policies and procedures of the authority, and the name of a contact person to whom requests under the act are to be directed. The following information serves to fulfill this obligation and to provide an overview of the resources at ministry of justice headquarters which the public is entitled to access.

The Ministry of Legal Affairs and Constitutional Reform is charged with responsibility for upholding the constitution and legal system of Bermuda; the incarceration and rehabilitation of offenders; and the provision of substance abuse treatment and education.

The departments that come under the umbrella of the Ministry of Legal Affairs and Constitutional Reform are:

  • The Judiciary
  • The Department of Public Prosecutions
  • The Attorney-General’s Chambers
  • The Department of Court Services
  • Financial Sanctions Implementation Unit
  • Financial Intelligence Agency
  • Legal Aid Office

Section A: Structure, Organization and Legislation [s5[1]a]

Description Of Structure /Organization And Governing Legislation

Ministry of Legal Affairs and Constitutional Reform under the auspice of the Minister of Legal Affairs is comprised of the following components:

The Permanent Secretary who has oversight of the civil service administration for the entire Ministry and direct management responsibilities for the Legal Aid Office and the Financial Sanctions Implementation Unit as well as toward the following:

  1. An Administrative Assistant providing service to the Minister and the Permanent Secretary;
  2. A Controller in charge of the accounting transactions and financial records for the Ministry; and
  3. A Policy Analyst who assists with policy formulation.

The Legal Aid Office and the Financial Sanctions Implementation Unit also come directly within the remit of Legal Affairs Headquarters.

Legislation

The role of the Permanent Secretary is defined by section 61[5] of the Bermuda Constitution Order 1968 and by the Public Service [Delegation of Powers] Regulations 2001per his/her role as Head of Department under the schedule.

Section B: 1] Functions, powers, duties of the Authority [s5[1]b]

Functions, Powers And Duties [Including PATI]

Ministry of Legal Affairs and Constitutional Reform is responsible for making information available to the public about its operations per Part 2 of the Public Access to Information Act 2010; and to oversee all departments that fall within the remit of the Ministry so as to ensure that Departments that fall within the remit of the Ministry so as to ensure that:

  • Government policy initiatives under the direction of the Minister of Legal Affairs and Constitutional Reform are being advanced;
  • Departments under its remit are fulfilling their functions in accordance with legislative mandate and/or Government policy objective; and
  • Ministry departments are coordinated in their pursuit of Ministerial policy objectives.

Headquarters further ensures that Government’s legislative framework is updated and current with Government’s policy directives.

Section B: 2] Obligations under PATI [s5[1]b]

To provide an information statement for the public and promulgate it [s5].

  • To provide other information to the public so that the public needs only to have minimum resort to the use of the Act to obtain information [s6]. This includes:
  • General information, e.g. activities of the Authority
  • Log of all information requests and their outcome
  • Quarterly expenditure [upon request] [s6[5]]
  • Contracts valued at $50,000 or more.

To respond to information requests in a timely manner [sI2-16]

  • To track information requests, and provide this data to the Information Commissioner
  • To respond to requests from the Information Commissioner [s9]
  • To amend personal information held by the Authority that it is wrong or misleading following a written request by the person to whom the information relates [s 19]
  • To conduct an internal review if formally requested [part 5]
  • To give evidence for review by the Information Commissioner [part 6, 47[4]], or for judicial review [s49], if required
  • To provide an annual written report to the Information Commissioner of the status of information requests [s58 [3]].
  • To do anything else as required under the PATI Act and subsequent Regulations [s59, 60], including:
  • Fees for Requests for information
  • Management and maintenance of records
  • Procedures for administering the Act
  • To train staff and make arrangements so as to facilitate compliance with the Act [s61]

To designate one of its officers to be the person to whom requests are directed [s62].

Section C: Services and Programs [s5[1]c]

Summary Of Services [including programs]

Ministry of Legal Affairs and Constitutional Reform provides the following services and has jurisdictions over the following programs:

  1. Assisting the Minister of Legal Affairs and Constitutional Reform with policy formulation as required;
  2. Consulting with stakeholders toward policy formulation;
  3. Preparation of Cabinet papers with supporting policy documentation;
  4. Preparation of Drafting Instructions for codification of policy;
  5. Attending Attorney-General’s Legislative Policy Committee to support finalization of draft legislation;
  6. Preparation of documentation for tabling legislation;
  7. Assisting with the gazetting of legislation;
  8. Ensuring proper management of budgetary and other resources allocated toward fulfillment of the Ministry’s mandate; and
  9. Overseeing component divisions as to their meeting statutory requirements.

Ministry of Legal Affairs and Constitutional Reform is also responsible for overseeing the management of the Legal Aid Office and the Financial Sanctions Implementation Unit, with the support of an administrative staff.

Financial Sanctions Implementation Unit

The following are records held by the FSIU:

I. Records held on behalf of the FSIU and which are presumed to be exempt as per sections 28 and 29 of the PATI Act are:

  • Information received pursuant to the statutory powers delegated by the Governor to the Minister of Legal Affairs and Constitutional Reform;
  • Correspondence between the Unit and UK authorities in the fulfilling of Bermuda’s international financial sanctions obligations.
  • Correspondence and documents relating to any deliberations concerning exemptions and licenses pursuant to the International Sanctions Act 2003 ; and
  • Correspondence between the Governor of and the Minister/Permanent Secretary concerning advice given in the discharge of the statutory functions.
  • Memoranda submitted to Cabinet for consideration by the Minister of Legal Affairs and Constitutional Reform. Such documents are presumed to be exempt as per section 27 of the PATI Act;
  • Information transmitted between the Unit and law enforcement agencies intended to detect and/or prevent the commission of offences under Bermuda’s financial sanctions regime. Such documents are presumed to be exempt as per section 34 of the PATI Act;
  • Legal research and opinions provided to the Minister by the FSIU and/or legal personnel within Ministry of Legal Affairs and Constitutional Reform agencies, to support FSIU’s advisory function to the Minister. Such documents are presumed to be exempt as per sections 29 and 35 of the PATI Act.
  • Correspondence with Government House concerning the discharge by the Governor of statutory functions imposed on her by the UK Government under a suite of legislative Orders in Council made by the UK Privy Council under the Sanctions and Anti-Money Laundering Act 20188. Such correspondence are presumed to be exempt as per section 33[1][b] of the PATI Act.

Public Health [Covid-19 Emergency Powers]
[Phased Re-Opening] Regulations 2021

Large Group Exemption

Whereas the Minister of Youth, Culture and Sport considers that Sara-Ann Tucker of Devonshire Recreation Club is justifying an exemption from the prohibition in regulation 5[5] of the Public Health [Covid-19 Emergency Powers] [Phased Re-opening] Regulations 2021 on groups of more than 20 persons assembling;

Now therefore, the Minister grants an exemption under regulation 5[5] of those Regulations to Sara-Ann Tucker of Devonshire Recreation Club and 1 Lookout Lane Devonshire DV 05, permitting a gathering of 100 persons to assemble for the purposes of the Bermuda Football Association Premiership Football Fixtures on the dates and times set out below, at Devonshire Recreation Club and 40 Frog Lane Devonshire DV 02, subject to all public health laws and regulations in place at the time of your event, the standard large group conditions below.

Standard Large Group Conditions:

  • 1. The number of attendees at any event cannot exceed 50% of the normal capacity at any indoor or outdoor setting. ‘Attendees’ include hosts, organizers, staff, volunteers, players, coaches, officials, spectators and vendors.
  • 2. The use of SafeKey is required for attendees at gatherings above the permitted number of persons. Event workers and sport groups can use the antigen testing framework in the Return to Play Guidance. SafeKeys must be checked against a valid ID with name and date of birth, and be verified on https://verify.gov.bm/ prior to entry, per guidance at www.gov.bm/safekey.
  • 3. Masks must be worn indoors and outdoors by staff and patrons if 6 foot distancing cannot be maintained, unless eating or drinking, or with members of one household or during physical exertion, per Public Health Guidelines at: www.gov.bm/mask-guidance
  • 4. Contact tracing details must be collected from all attendees including full name, date and time of visit, phone and email in case there is a positive case in attendance.
  • 5. Signage must be available throughout indoor and outdoor settings encouraging physical distancing and indoor mask wearing.
  • 6. Marshalls must be deployed at the rate of 1 Marshall per 50 attendees, in particular at the entrance, bathrooms, food and drink vending, and narrow and enclosed areas to enforce 6 foot distancing, hand hygiene and mask wearing. Marshalls can include adult staff, volunteers and security. The event organiser shall identify the Marshalls by name to compliance and enforcement officers.
  • 7. Sanitizing stations must be available at the entrance of any indoor setting and on tables and bar counters.
  • 8. Lines for food, drinks and bathrooms must be marked to ensure 6 feet a distance between each person waiting in line.
  • 9. Staff should complete the online Infection Prevention Control training available at: www.gov.bm/infection-prevention-and-control-training
  • 10. Food and beverage vendors must comply with Environmental Health licensing and food hygiene regulations and requirements.
  • 11. Employees must be screened for signs/symptoms of Covid-19 at the start of their shift. Sick employees must be directed to stay home or immediately go home if they feel or appear sick.
  • 12. Adhere to cleaning and disinfecting Public Health guidelines at: https://www.gov.bm/covid-19-guidance-events-and-gatherings
  • 13. WeHealth is strongly encouraged as it will help contain an outbreak in case of a positive case at any event whether above or below the permitted number.
  • 14. A copy of this “Letter of no objection” for the Large Group gathering and the conditions must be posted at the entrance and clearly visible and kept on file to be made available upon request

The Ministry of Youth, Culture and Sport reserves the right to withdraw the permission to have more than the permitted number of persons assembled at the event without notice or cost to the Bermuda Government subject to the status of Covid-19 in the local community.
The Bermuda Police Service and Officials from the Ministries of National Security, Health and Youth, Culture and Sport have right to attend and observe compliance of the conditions as prescribed above.
