Speeding Ticket Dismissed Due To Wrong Date

A speeding ticket was dismissed in Magistrates Court after lawyer Elizabeth Christopher argued that her client was “improperly before the Court.”

Ms Christopher’s client Diego McCallan had been ticketed for speeding on 5th December 2013, and the police officer had written on the ticket that the driver was to appear in Court on 16th January 2013 – a date already passed as the year had been noted incorrectly.

The ticket had resulted in Mr. McCallan’s name being called in Court on 16th January 2014, and as he was not present a warrant.

He appeared in Court on a subsequent date, however following arguments made by Ms Christopher about the date discrepancy, Senior Magistrate Archie Warner dismissed the speeding charge.

    Been going on for decades. Got away with a wrong date one myself many years ago.

    If they can’t get the dates, the place, the time or some other pertinent detail right on traffic offences you have to wonder what goes on in major crime & get charges thrown out.

    Imagine the consequences of your pharmacist making ‘little’ mistakes in your prescription in drug type or dosage potency.

    Come on BPS, you can do better.

    Cut ummm some slack (police). I’ve written 2013 on many documents up until about Mid- Feb when I get use to 2014. They (police) are not perfect.

    Ms. Christopher must be laughing all the way to the bank! What should really matter is whether the defendant committed the crime, not whether the court date was correct.

    Maybe I should have called Ms. Christopher when I got my speeding ticket and the ticketing officer spelled Southampton 3 different ways on my ticket and all of them were incorrect…
