Man Fined $2,500 For Cocaine Possession

52-year-old Kevin Charles Robinson faced a Magistrate today [Aug.29] on a drugs charge stemming from a 7th April 2011 arrest with Robinson pleading guilty to the two offences with which he was charged – possession of an illegal drug and possession of equipment intended for use with an illegal drug.

In April, patrolling police had seen Mr Robinson and another man in the vicinity of the Hamilton Bus Terminal. Police observed that their actions were consistent with those of persons selling illegal drugs, and police sought to arrest the two men.

At the time, only Mr Robinson was actually apprehended and he was taken in City Hall Car Park. On being searched he was found to be in possession of a homemade ‘crack pipe’ and a cigarette package containing five twists of a substance later found to be crack cocaine. Total weight was said to be 0.1 grams.

Mr Robinson appeared before a Magistrate, pleaded not guilty, and was bailed to re-appear for trial on 30th July. Robinson failed to attend for his July trial. He was picked up this weekend and held in custody until his court appearance this morning.

Asked by Magistrate Archie Warner if he had anything to say, Mr Robinson replied that: “I had just learned that I had diabetes” and duty counsel Kendrick James helped with Mr Robinson’s explanation by suggesting to the Magistrate that Robinson was probably depressed by that medical revelation.

Before sentencing, Mr Robinson said that he was now in a drug rehabilitation program at MAWI and that he was working.

Magistrate Warner fined Mr Robinson a total of $1,000 plus another $1,500 for being in possession within an Increased Penalty Zone – the Bus Terminal. On Mr Robinson’s request, the Magistrate gave him thirty day, until 29th September, to pay the $2,500 total fine.

    haha that’s how police work is done, arrest the guy buying the crack and give him an outrageous fine. let the dealer walk away..

    This sentencing is pointless and our outdated drug laws need to be modernized. How is a person who is addicted to crack going to pay a $2500 fine? Our backwards laws treat drug addiction as a criminal act and not as a medical condition. Making him pay this fine is not going to get to the root of his problem. Our laws need to treat drug addiction as a medical problem so that these individuals can get the help they need and so that they can overcome their addictions. What’s going to happen in this case? He probably won’t be able to pay, end up serving a 30 day sentence, and then be back on the street still with the drug addiction.

        NO DOUBT! Their is always a reason for government not being able to change this or that, regardless of how genius an idea it may be.
        The only thing they are capable of doing is raising fees, taxes and fines. If it doesn’t involve any of those three, the it’s impossible to do! Inefficient, inept, and ignorance.

      Same thing i was thinking “jus askin” I am so lost now on how our system works. So its ok to be carrying crack tools and crack cocaine, but its NOT ok to carry papers and half a joint??? Did i miss d memo??

    Maybe so Wolfy…….but the person who sold the stuff was not in possession so basically is not guilty of anything unless caught.
