Court: Cannabis, Knife and Escaping Custody

Jahroy Simons, 25 and living in Southampton, pleaded guilty to and was convicted of two counts of possession of cannabis in Magistrates Court this morning [Apr.6]

The first charge arose out of a police stop-n-search operation on Queen Street in Hamilton on 3rd October 2010. In this incident he was found to have 0.8 grams of cannabis.

The second charge arose out of a police stop-n-search operation on Queen Street in Hamilton, thirteen days later, on 16th October 2010. In this incident he was found to have 1.7 grams of cannabis. Twice as much as before.

Because each offence took place in an increased penalty zone – within three hundred metres of Par-la-Ville park – Mr Simons, on each charge, was fined $1,000 for possession and $1,500 for being in an IPZ. Total fine was $5,000 and Magistrate Warner ruled that the fine must be paid immediately, that is before close of business today, or Mr Simons must serve 90 days on each charge, with time to run consecutively.

Mr Simons also faced two other charges. One of escaping lawful custody on 5th April 2011. He pleaded guilty to this charge and the Prosecutor gave evidence that Mr Simons had been stopped and searched in Victoria Park, and had been placed under arrest for having a ‘pointed article’ with a 3.5 inch blade in his possession. He had then run away only to be recaptured about 100 metres away at the North end of Washington Street.

The second charge stemming from this incident was that of possessing a “pointed article”. Mr Simons pleaded guilty to the escape charge but not guilty to the possession charge. Magistrate Warner ruled that the two charges would be dealt with together and that Mr Simons would be bailed for $5,000 with one surety to appear for trial on 20 July 2011.

    Up to 6 months for 2.5grams of Marijuana. Shocking. This crazyness has got to stop. If he had a couple oz in bags for sale, fine lock him up. But, 6 months for minor possession for personal use is cruel and unusual.

        Where is the consistency in sentences?? If weed is illegal, then no matter what your previous record is yo ushould be getting hefty fine or a hefty sentence! Think about it, we are saying that if you have no previous offences then yo ucan go free. But let there be murder or something major we want to through the book at em! All I am saying is that there is no consistency with our current system. And to let ya’ll know, the youths of today know and see the flaws and it is a major factor with why they have no respect for it! In thier eyes we that support this broken system are complete idiots because just like the system wee contradict ourselves.

        Also, contrary to a comment made by someone below that no weed = no murders, that is just a far fetched rediculous comment because there would be still cocaine, heroine, LSD, PCP, and the list goes on! Get educated mate.

One can show that he is working to be a positive contributor to himself, his family (future?) and also country and the other guy is a repeat offender who to my knowledge has not presented any argument for him self to show he is serious about staying to the straight and narrow WTF he not only did he have weed on him twice he had a knife and tried to escape custody again justify you opinion all you want the facts just don’t support your argument.     meanwhile, his little 2.5 grams which probably cost him around $100, could cost us approximately $45,000. doesn’t make sense to me. There has to be another way of dealing with these situations.

    “Accounting Intern Has Weed Charge Dropped” was the title of an article last week and yes I am going to go there..please explain to me how the hell one person can get off and others charged….it really makes one believe that it is who you know and it is definetely something that makes you go hmmmmmmmm…….that’s why this island is so “f&*^ed-up” there doesn’t seem to be any consistency in sentencing…I swear they must spin the wheel and wherever the pointer stops is what you get!……

      Did it every occur to you that Simons has a bad record of offenses? This island isn’t effed up, Simons simply didn’t learn his lesson. I’m sure if the inter got caught twice within 2 weeks and then had other charges brought up against him then the judge will throw the book at him. This is a clear case of some people learning from their mistakes and some who do not.

        @ Reality….Whatever the fact that his (interns) charges were dismissed altogether is my point. You know for a fact that there is no consistency when it comes to sentencing period..you read cases everyday in the paper..did that occur to you??? I’m glad you feel that you know what the Judge would have gave him (intern) if he had committed another crime..sounds like you have a crystal ball..I along with many in the community can concur that sentences metted out are sometimes not adequate for the crime committed……..

This guy vs the intern atleast the intern is doing something with his life and is persuing the road that could lead to him being a positive contributer to our contry but I guess you would rather him to have the record so we can add another of Bermudas youth to the criminal/gang list you must be one of those that want to lock up all the black youths or something. What is this other guys story is he doing anything? Also he seems to be a repeat offender this is part of the desion the intern had a clean record in the laws eyes as he had never been charged before. The last artical you and others were upset about was an importation charge again not the same thing as possesion.

              No sorry murder is a capital offense possession is not period. These crimes are not in the same category please keep your arguments in perspective of the severity of the crime. Again I repeat MURRDER is a CAPITAL OFFENSE in this case it does not matter if the person committing this crime has a prior its murder. In the case above (this article) again I repeat this guy is a repeat offender and has not presented any evidence that he is trying to straighten his ways.
