Writs Filed In Supreme Court Against Bean, Burt

[Updated] According to Supreme Court records, three writs have been entered today [Feb 21] with Premier Craig Cannonier filing against Opposition Leader Marc Bean and MP David Burt, while Minister Shawn Crockwell and Attorney General Marc Pettingill also filed against Marc Bean.

Writ No 74 names Premier Craig Cannonier as plaintiff and MP David Burt as the defendant. The law firm entering the writ is identified as Conyers, Dill, & Pearman.

Writ No 75 is Premier Craig Cannonier as plaintiff and Opposition Leader Marc Bean as the defendant. The law firm is Conyers Dill & Pearman.

Writ No 76 shows Minister Shawn Crockwell and Minister Marc Pettingill as plaintiffs and Marc Bean as defendant. The law firm is MJM Ltd.

The controversy began last week Friday with strong allegations made in the House of Assembly by both Mr Bean and Mr Burt, which they both subsequently repeated outside of Parliamentary Privilege.

The Premier later held a press briefing on February 19 where he denied both Opposition Leader Marc Bean and MP David Burt’s allegations, and said he will be seeking “full damages through the Courts for slander.”

Update Feb 24: This article originally stated that the writs on behalf of Minister Crockwell and Minister Pettingill were filed by Conyers Dill & Pearman, as stated in the Supreme Court cause book. However, the records have since been amended to reflect that both Ministers are actually being represented by MJM Ltd.

        The Premier needs to address the QUESTIONS and stop hiding behind Lawyers to save his butt. The reality is he may not be save even with the use of 10 lawyers…TRUTH will WIN OUT..

          After all, it would prove they are not intelligent enough to provide serious opposition if they cannot follow the laws on slander (or the production, sale and distribution of alcohol including copyright infringements).

            And likewise, if they lose their legal battle, the premier and minister of tourism should step down. And, all three should give a humble public apology to the DEFENDANTS and the people of Bermuda.

            I hope the Supreme of Court combines all the writs into one case against the DEFENDANTS (Bean & Burt). It will save in costs, legal fees and Court time.

            Interesting…Crockwell and Pettingill may be called to give evidence against the premier.

            Slander is a very difference legal case.

              Beans Defence against A-G and Crockwell is limited as he was repeating what somone else said (so whay=t he alleges the Premier they clearly deny it!)…different case. He will have problems here and may want to consider an early mia culpa that he should not have said anything in the circumstances about them! They have lawyered up it seems and if he tries to have his side kick Daniels or another PLP lawyer not expert in defamatioin law take in the case he us likely to get burned

            BETTTY you are correct, despite many refusing to except the truth due to their loyalty to one party or another. This action by the Premier is a waste of time, and nothing more than a distraction. It does nothing for Bermuda, except pull us further apart. He is not willing to answer key Questions. This can go on for more than one year. At the end of the day, the Premier is losing more money and his business suffer, and the OBA are now ready to get rid of him all together. Now is just time to save their position in power. Any political astute persons can see that.

      I am praying for this island of Bermuda. I have never seen such disgusting tactics. Politics all around the world has to deal with political slander. Some of the worlds known leaders are subject to the opposing parties slander.The presidents,prime ministers,etc. Who died and made you God….Jesus took much slander and abuse, all he did was pray for them. They slandered Dr Browns name, Jennifer Smiths, Renee Webbs etc. Who do you think you are? Did Mr Bean & Mr Burt hurt your little feelings. That’s not the way to prove to the public your innocent of the accusations. What type of leadership is that? So anybody who talks about you and you say their lying your going to take them to court? Are you paying for it, or is that coming out of governments funds also. So now your focus is on a court case, still not on the running of our country. Your suppose to be talking peace for our country, yet you can’t even forgive and move on. What type of example are you giving to the young.         This is way beyond feelings being hurt. We have the Opposition leader making strong allegations while investors are considering returning to Bermuda. These things cannot go unchallenged, nor can they be made without proof. This isn’t about Cannonier, this is about Bermuda.

          If we voted for change, why excuse the OBA actions in this regard, and excuse them by suggesting well the PLP did it. I think you need to provide a better summary than that. It is weak at best. Folks voted for change, and what did we get, it seems even more critical than the actions of the PLP. I just want the Minister and Premier to be honest and stop allowing this to be a distraction in Bermuda. The Premier has failed to at least one, answer the people of this country.

        Statements have been made and denied. Is there any proof? If so then Bean and Burt will be proved right and the Premier will have some explanations and probably resigning to do. If they are found to be slanderous then Bean and Burt will have to cough up some money and apologise.

          for Cannonier v Bean, Bean will plead in his defence that the statements were true and in the public interest

          since the alleged defamed statements were based on a private conversation the two of them had the only way the court will be able to ascertain the truth is by a trial with both of them giving sworn oral testimony tested by cross examination

          whoever provides the most convincing testimony and is not shredded by cross examination will probably receive judgment in their favour

          in any event it will be a three ring circus as both reputations will be on the line

          the same can be said for Cannonier v Burt

          as for Crockwell & Pettingill v Bean no such private conversation took place so the only evidence the court can consider is Bean’s oral testimony tested by cross examination

          Bean’s reputation will be on the line but not Crockwell’s or Pettingill’s as they won’t be required to give evidence and subjected to cross examination

          in a nutshell Cannonier shouldn’t have filed suit as he will be put through the ringer however Crockwell & Pettingill should have as Bean will be the one put through it

          the OBA are probably fixing to kill two birds with one stone Cannonier and Bean

            In defamation cases the person who made the allegation has to prove it. Cannonier has nothing to prove.
            Public interest is not a defense if the allegations were made maliciously. Burt and Bean acted together in a 4-day orgy trying to destabilize the elected givernment by making scandalous allegations. The prosecution will be able to argue that it was deliberate, coordinated, and malicious.
            Bean and Burt will be the obes sweating.

              Cannonier does not have to prove it, but the evidence is NOT just oral submissions.

              The defendants can request from the Court all documents pertaining to gaming during the timespan immediately before the premier announced that the referendum will not take place. There may be evidence there to support their allegations that there were other hidden motives in regarding the referendum and they (or he, Bean) was deceptively maligned.

              The above is just a hypothetical…

                Public Interest was argued in the Reynolds case against the newspaper in the UK, now known as the Reynolds defence. The newspaper argued that there was a ‘public interest’ in publishing the libellous statements, but Reynolds (the defendant) counter argued that the repeated publishing of the libellous statements were maliciously intended.

                Public interest can also be argued in the fair comment defence.

                Does the remarks rise to malicious intent, based upon the foundational facts, no it does not, in my humble opinion.

                    If you believe that Bean & Burt just concocted their stories, then it is equally believable that premier concocted his reason why the referendum was cancelled.

                    But think back, the Opposition’s allegations were in response to the premier’s accusation that the PLP was going to disrupt the referendum by having their voting members abstain from voting on the referendum.

                    Sandy Bottom, if I have to repeat the premier’s accusations about the Opposition on the referendum to you, you have NOT been following this saga very closely.

              Bean’s allegations stem from a private conversation that he and Cannonier had

              Bean doesn’t have to prove that what Cannonier said was true he simply has to prove that he and Cannonier had the conversation and that Cannonier made certain statements and that he was revealing publically the nature of those statements

              in effect he is using Cannonier’s own alleged statements against him

              therefore in order for Bean to prove this he simply needs to state it under oath and be subjected to cross examination

              either the judge believes Bean’s version of the conversation or he doesn’t

              Cannonier may choose to not say anything under oath but if he doesn’t he wouldn’t be able to counter Bean’s version of the conversation which will end up being the only evidence for the judge to consider

              Bean will probably not be found liable for defaming Cannonier as you really can’t defame a person for something that person has told you themselves

              now as it relates to Crockwell and Pettingill Bean has defamed them based on what was discussed in the private conversation that he had with Cannonier

              since Cannonier was allegedly running his mouth about his Cabinet colleagues these statements amount to no more than hearsay and gossip and Bean is clearly liable for defamation for stating them publically

          Burt and Bean have gained a lot of respect for not hiding behind ‘parliamentary privilege’ and sticking to their word. This matter will divide the country with the majority favoring these two gentlemen.
          I have said it before and I will say it again “The BDA members of OBA days are numbered” They can not blame anyone but themselves. Hiding behind the law is a ‘Mitch Move’.
          Feel free to believe they do not have proof but you will be shocked as OBA are not the only ones that record conversations.
          This matter has proven that the PLP have tried to reach out and work with the current government. Their efforts were mocked and disrespected.
          OBA received all the votes they were going to receive in the last election. They will have nothing but an up hill battle from here on in. ;-)

      Burt will say “he said this”, Craig will say “no I didn’t”.

      Burt will say “but your honour I swear on a stack that he said this.”

      The judge will say “that’s nice, do you have any evidence?” The case will go nowhere, and the lawyers will bill us $200k.

      We will all be $200k poorer because Burt decided to spout off on national radio, instead of spouting off in parliament like he normally does. A few things that could have gotten done for our benefit, will unfortunately be delayed while this circus runs its course, and a few people overseas will have a chuckle at our expense.

      I tend to feel better if I just remind myself that this sort of thing is normal for small town or village politics.

        This is the first post that I have read from you on this matter that sounds objective.

        It is about ETHICS, political ethics.

        If the premier knew that the PLP had nothing to do with his decision NOT to have a referendum, then why target them? Diversionary tactic?

        This saga kicked off after the premier’s announcement about the referendum, nothing to do with Nandi Outerbridge and her tape. The tape is being dangled in front of the public to demonise Bean. But Ms Outerbridge may want to preserve it, just in case the Court does want to listen to it. And if the Court does, Ms Outerbridge be prepared for some very harsh criticism from the Court.

        It’s about the gaming referendum and how the premier has very carefully undermined Bean and made him the fall guy or the diversionary ploy whilst he (premier) setup the gaming legislation and kept his popularity ratings favourable.

        A balancing act, but you cannot accuse the Opposition of planning to undermine the referendum without a rebuttal from the Opposition. And you cannot claim that their rebuttal is ONLY being voiced because of parliamentary privilege. So, when the Opposition foregoes parliamentary privilege, now you claim it is being stated with malicious intent. They defended their right to speak the truth without the legal cover of parliamentary privilege, there is NOTHING malicious about that.

        I do NOT expect all or even any bloggers to see it my way, but the entire background on WHY the referendum will not take place lacks credibility.

Politics will always be politics no matter who is in what is important is we try to climb out of the very deep hole the last administration put us in it will take all of us to get out of this hole and that means even you…. saying what they may in Parliament is one thing but to come out in the public domain and do it well…. you better have proof maybe they do but then if they did it would have come out and criminal charges laid, my suspicion is there is none and a price will be paid ….but someone is going down if proved Cannonier is history and maybe a few more OBA but if not well you know, i don’t have to say ….

However it looks like he’ll soon be history as well at this rate. He needs to get out of the job quickly so that he can go and open a church where he can preach to the Sheep!       If we are holding government accountable, to suggest the PLP did it, makes it okay for the OBA is not the way to go. We should hold the OBA up to the standard of ACCOUNTABILITY that we expect of all governments. So stop using such weak statement to support or excuse the actions of this current government, they are wrong, and wrong is wrong.

And it’s a good thing Drifter,that after 4yrs Dr.Brown lives freely in you peoples collective memories(you constantly measure every bad decision made by the OBA against every perceived bad deed done by Dr.Brown and the PLP ) so thanks for that endorsement . What rankles you people the most is that Dr.Brown lives , unconsciously in your very psyche and there is absolutely no way that you could ever forget about him .     This is a very sorry spectacle for Bermuda, but like it or not, the Premier has taken the bull by the horns and has now filed the necessary papers to have the allegations made against him heard on oath in court. To suggest that he is hiding behind lawyers is downright ludicrous because he will be subjected to rigorous cross-examination by lawyers.

    If the Premier had not taken this action there are those who would believe whatever Mr. Bean and Mr. Burt have alleged, and likewise, those who would believe the Premier whatever he says or doesn’t say.

    So take it to court. Let’s all hear the evidence, under oath, and let the chips fall where they may. I personally believe that the Premier should resign if he loses this case, but likewise, Mr. Bean and Mr Burt must step down if they cannot prove their allegations in court.

    There will be all types of fallout from this Lawsuit such as the opposition building up the emotions of
    60% of the population for the next election but it could go the other way too and back fire on the PLP – this is going to get crazy!

    Based on most such writs, remember Dr Brown was very fond of issuing the against the citizens, it is highly unlikely that anything action will be take and in a few months they will be forgotten about. Looking at the bigger picture it all about marginal votes in St George’s and St David’s. If the OBA manage to complete a new hotel in St. George’s and reopen the golf course the PLP stand little chance in an election. All this “he said she said” is electioneering. The writs are a civil matter and surprisingly require much more proof than a criminal matter. Saying under oath that it happened will not win, and which is why they rarely make it to a court hearing.

    Now let’s get back to healing Bermuda.

Mr. Bean is going to find his defence against them very difficult, ” I was told it by a third party” will not offer him a defense at all. he better get some advice from a Lawyer who knows Defamation well. Prove it or lose it!!! You have problems on this one Bean. Premier is a case of “he said he said”…The Minister and A-G are a differen case and YOU Mr. Bean have a different problem! Funny, with all those lawyers in your camp if you really told them in September about the conversation on bribes with the Premier that they never advised you then! Just saying, kinda funny…

    IMO – no matter who wins or loses, neither will step down.

    A couple of other things to:
    1 – Dr. Brown is no longer party leader of the PLP, so to lay his blame on Mark Bean and the whole party is foolhearted. New leadership, and new direction.
    2 – I am pretty sure that this plane ride was for the betterment of the island.
