Court: 19 Year Old Charged After Fatal Collision

cup match crash 2014 (2)A 19 year old male appeared in Magistrates Court this morning [Aug 6] charged in connection with the collision on Kindley Field Road over the Cup Match holiday that resulted in the death of 51 year old Melvin Smith.

Calin Maybury was charged with causing the death of Mr. Smith by driving without due care and attention, and was also charged with causing grievous bodily harm to Mrs. Dawn Santucci-Smith by driving without due care and attention on the same date.

Both charges stem from the collision in the early hours of 2nd August 2014 on Kindley Field Road in St George’s.

Senior Magistrate Archie Warner granted the defendant $10,000 bail, required a surety, and set a mention date for later this month.

Because the charges are indictable and can only be tried in Supreme Court, Mr. Maybury was not required to enter a plea.

    Without knowing the exact circumstances, my sympathies lie entirely with the family of the dead and injured. I’ll be interested to hear what defence the accused eventually produces, but, based on what little I know of the circumstances, I don’t think he has any excuse for his alleged actions.

      I don’t think it is about excuses. We do not know the facts of this case. And we shouldn’t jump to any conclusions. It’s just so sad that someone has died and that someone so young is involved.

    I know the young man and if you ever met him you would know that he is a good kid and extremely remorseful. I pray for him and his family gets through this and learns from this situation. I also pray to the family that lost their loved one. It’s hard to loose someone so tragically and I hope that they can deal with the situation and be strong.

        What’s really sad is the decision he allegedly made. I really feel for the family of the deceased. My family went through a really rough time because of someone’s wrong decision and thankfully I survived but my friend didn’t. May God be with both families.

His humility has always been an endearing quality and I pray that he gets all of the support he needs.     My heart goes out to Mr. Smith’s family during this difficult time dealing with the loss of a loved one, and wish you comfort and peace.
    As a mother of 2 teenage boys, my heart is sadden by the event that has changed this young man’s life forever and pray for his family as well. We MUST continue to speak to our young adults about choices that will/can change their lives in a second and hope many will make better decisions from this unfortunate and tragic accident.

    @Anne – I agree 100%. I also have two boys (now men) and there but for the grace of God go any of us. Somehow we have got to get this message through to all bike and road users. I pray for both families and hope somehow, in the future, these 2 familes can heal and mend and function. Young man (Calin) use this time well so that the loss of Mr. Smith’s life is not in vain.

    Here is what is crazy. This young man, volunteered on the night in question to take two of his friends home who had drank to much. the last person he dropped off lived in St. Davids. he was arrested and he passed the breath test. He is a good kid. Everyone who knows him from work, to community and sports speak highly of him.

    please lets not judge him. In this case, justice must be tempered with mercy.

    I’m glad to see people aren’t calling for this young man’s blood, which is what I initially thought might happen.
    I know Bernews cannot allow certain comments ad this has to go to court. However, from what I understand and obviously due to his age, this young man hasnt had his driver’s license very long. Thankfully, he wasn’t drunk. So sad and tragic all around, especially since I have a child that age who has just recently begun driving.
    My heart goes out to all involved. Tragic doesn’t even begin to sum this up.

    I totally agree JH. It’s a horrible and tragic situation. A woman has lost her husband. She is still in the hospital suffering with her injuries and all persons can say is keep your head up Cal?!!! This woman’s husband died.       The heading is “19 yr old charged…”. That’s why most comments are addressing Calin. Now if the heading read, “Woman loses husband of 15 yrs”, then I believe the posts would be directed to Mrs. Smith. It’s that simple. Nothing complex or purposefully disrespectful.
      But now that you’ve mentioned Mrs. Smith, “Smith family, we love you. And keep you’re head up”!

    This is so tragic. Since the first year I was in Bermuda (5 years ago), I said that those campers were risking their lives. I hope either people camp elsewhere, or they put up some barricades. Car accidents happen, and this is the tragic result.

    Prayers for both families. If found guilty, the likelihood of this young man doing hard time is rare. A former saltus student/tennis player took a tourists life riding impaired and did probably a year. But that’s none of my business..*sips tea*

          In addition, people are always giving God credit for miraculously saving the life of some individual during a horrible disaster where dozens of others have just perished.

    At the end of the day there is a lot of nice people in Bermuda…but that is no excuse you can give somebody. The young man made a decision. The nicest man that I KNOW his life he was a good father and husband and now his family has to suffer……..knock on wood but if the tables were turned on you, you would want justice for your family too.
