David Cox Sentenced To Life In Prison

David Cox was today [July 19] sentenced to life in prison for the murder of 47-year-old Raymond Troy “Yankee” Rawlins. The Judge ordered that Mr Cox must serve a minimum of 38 years in prison before he can be considered for parole.

On August 9th 2010, Mr Rawlins was gunned down in the entrance of Spinning Wheel nightclub on Court Street. Mr Cox was arrested shortly after the shooting, and charged with murder on August 25th 2010.

During the trial the court heard that Mr Rawlins was shot 16 times, viewed the CCTV footage of the shooting and heard that Mr Cox’s DNA was found on both a baseball cap found by the crime scene and a glove found by the getaway car.

Testimony was also presented that the guns used to kill Mr Rawlins were used in a number of other shootings, and that Mr Rawlins had ties to Parkside, while Mr Cox was said to have ties to 42nd.

On June 10, 2011 the jury convicted Mr Cox by unanimous verdict. After the verdict Mr Cox’s lawyer asked that sentencing be delayed in order to allow mitigating factors to be submitted, and Mr Cox was remanded in custody until his sentencing today.

Speaking after Mr Cox was found guilty last month Detective Chief Inspector Nicholas Pedro said, “We have put a very dangerous man behind bars. Make no mistake, Bermuda is a very much safer place today with Mr Cox convicted for this murder. This was a brutal assassination of an unarmed and defenseless man.”

Detective Pedro and Assistant Commissioner David Mirfield speak after the verdict last month:

Although Mr Cox was the only person on trial, there were two gunmen involved in Mr Rawlins murder. No one else has been charged in relation to the murder at this time, however after the verdict last month Detective Pedro said, “We move on to the second shooter, and there will be more to follow in that regard.”

Mr Cox will be eligible for parole in 2049 when he is 70 years old. At the present estimate of $80,000 per year for each prisoner, housing Mr Cox will cost the taxpayer over $3 million.

      My comments are only intended to address the Bernews reference to $80,000.

      The often quoted cost of $80,000 per year to house a prisoner is misleading. It is calculated as the total cost of running the prisons divided by the number of prisoners. In order to reduce costs, we would have to reduce the number of prison officers and related costs.

      If we are realistic, having one less prisoner will have a very minor impact on the cost of running the prison. Chances are that there will be no impact since we will still have the same number of prison officers, food costs etc.

      In order to have a real impact on prison costs, we will have to find a way to substantially reduce the inmate population to the extent that we will require less prison officers since salaries and related expenses are the most significat portion of the cost of running the service.

    Am i the only one that kind of feels sorry that this guy has to spend basically the rest of his functional life in jail? 38 years without parole he’ll be 70 when he gets out. I agree that he’s a murderer and he doesn’t have the right to take anothers like but shocks. I think the death penalty would be more moral than this sort of suffering. Is it really worth wasting two lives? For some reason i feel it is inhumane to lock someone up for more than 20-25 years, i think death would be more ethical.

        The thing is, he won’t be suffering! They even get KFC some days to eat up there. They get given food, water, exercise, visitors, can watch tv, even manage to get drugs. So he’ll be living his life the same way, just in prison. No rehabilitation, no education, nothing. Just a waste of taxpayers money to keep him alive.

Who I feel sorry for are those who are left to mourn the loss of a loved one. 20-25 years from now, he will still be dead and there will be those who will still miss him. What is inhumane is shooting someone in cold blood and until his life leaves his body. Locking that person up for life, is justice.

And now Bermuda is left with three million dollars worth of damage because of these peoples affiliations with gangs.       I dont think that its cruel to lock a person up for that long at all, you do sound a little crazy in that regard. What I do agree with is the death penalty. He should be shot one-and-done. It saves money, plain and simple. He’s going to be off the streets when he is in prison, but he will waste $3 million as bernews notes. Kill him, as he has killed and waste no money from our already debted funds.

      Mind you, I do agree with your last remark “I think death would be more ethical.” I’m one of those old-fashioned individuals who think that, if you take a life, your own should be forfeit unless you can come up with a BLOODY good excuse, like maybe self-defence (which obviously wouldn’t apply in this case).     80,000 to sustain one prisoner? How is it possible that I live on less then that a year and I’m paying for everything myself, no husband or the likes a single woman….? There is something terribly wrong that it cost that much to keep a prisoner? He deservees to be in prison, but i think we need a revamp of what it is we provide in prison. You should be made to pay for your crime, not live the life of riley while those outside have a lot less…

He’ll probably have his already incarcerated minions do his bidding from the minute he arrives and he’ll have some type of racket set up in no time within the walls of the prison. I say put him in the hole (isolation for those who don’t know)…no care packages, no money, no visitors, nothing! Hell, don’t even let him shower…let him rot in his own stink. Perpetrators of premeditated murder don’t deserve any rights. Oh…and all you idiots who are supporting Cox, you’ll probably end up keeping him company, so good luck to ya! Maybe you’ll end up being his punk…won’t that be fun?

      Yes, it’s true he may have all those things available to him. But…and it’s a big but…at the end of the day, it’s the loss of freedom that does the prisoner in. That is what messes up their minds; that is what drives them to one form of insanity or another. Prison is no picnic, even to those who profess that they like it “inside”. It’s hard work keeping your position in the prison hierarchy. They are always on edge, looking over their shoulder for that one person who has it in for them (and there will always be someone). They have no choice in what or when they eat, when they can bathe, how they dress, what activities they can engage in…the list goes on and on. They work out because they have to be physically strong to maintain their personal power base. Most inmates with long or “life” sentences read and study because they’re bored, not because they want to improve themselves. They take on activities available to them as a coping mechanism so they don’t have to think about how wasted their lives are. While initially it may seem like a big game, but when they finally realize that this is their life for a very, very long time, they don’t like it…it’s merely what they know.

          Cripes, I hate having to repeat myself… It is the loss of “freedom”. Do you understand what that is? Yes, he has showers, food, lights, blah, blah, blah. And yes, some people don’t even have that. But what they do have is the freedom to move about the island or travel at will; they have the freedom to associate with whom they please; if they want to eat a pizza or cassava pie, etc., they can. They can embrace their loved ones and see their children grow. They can take in a movie or cultural event of their choice. They can go for a swim at Elbow Beach or walk along the Railway Trail whever the mood strikes. The list is long of what constitutes real freedom, but hopefully you get the gist of what I’m saying here. It’s the small every-day freedoms that these convicts have lost and that, as I said earlier, is what hurts them most. Don’t believe me? Go so something grossly illegal, get yourself caught and convicted and spend a couple of years or more in prison. Then come back here and tell me he’s “having it all”.

    Can some one in government break down the $80,000 a year for a prisoner. WTH are thy eating and getting? Steak, lobster, godiva chocolate etc? Is the prison shopping at Miles or Supermart. Bermy needs to serve bologna sandwiches for breakast lunh and dinner like a prison i saw n TV. The prisoners sleep on cots under a tent outside and wear pink overalls n pink boxes n flip flops. Or send them away to a prison in Santo Domingto where your family has to send money monthly so the prisoner can get meat on Sundays.

    Prisoners should be forced to do manual labor, have limited 3 minute showers with hot water, grow their own food, use lamps and the like to pay for their own room and board…No TV, books only….

That’s how people like him think and act…trust me, I know. Whatever is sad or horrible about his remaining years, it still won’t be enough to balance the scales.     With the mixed emotions of frustration and relief bouncing off the walls, keep in mind many of us “good’ citizens live in glass houses, just some glass is thicker than others. Neither of these men contributed to society in the way that was productive and with both of them off the streets is almost insignificant compared to what we face ahead. Go wait tables, wash dishes…whatever it takes to make an honest living and do it with a smile even though you might hate it. Do a good job and do it with grace, and you’ll eventually find a job that you actually like doing. Go take some courses or get on as an apprentice for a trade and stop screwing up your community and your country. It dont balance out, Ive been to numerous businesses looking for work and guess what, I’m stillin the same place s**t hasn’t changed. Its discouraging to walk in a business and see some Indian or Korean working who barely speaks english working but i cant get a job. WTF!!!! STOP ALLOWING ALL THESE FORIEGN JOB CONTRACTS!!!!

    They should have never outlawed hanging…would save us some money. The rope could be reused. At the rate the police are going solving some of these cases it could have been used quite frequently.

    In any event Mr. Cox’s reputation proceeded him. He has been well known to the police and court system and has had a propensity for violence. This as well as the other factors the judge noted help him reached his decision on the minimum sentence. In the case of Mr. Myers, I believe he received a life sentence as well with a minimum of 25yrs. His record is less extensive than that of Mr. Cox. I agree their needs to be consistency, however how our system is structured there is not likely to be much. Don’t forget people the law was only changed recently to allow judges to allow minimum time served before being eligible for parole in these type cases. In previous years it was just a 25 year sentence. Many murders were out in 15 years.

    The overall unfortunate part to this entire case is, us Joe Public has to pay for him until he takes his last breathe or is released after 38 years, if he is paroled. $80,000 to house a prisoner, that is the base….what happens if he get cancer and requires treatment? Who pays? We do….

    All goes back to my original statement, we should have never outlawed hanging…a rope is so much cheaper!

      TBH, we are unsure. Last info we had – was as you said – that he would be sentenced on the 22nd, however we have no record of him being sentenced yet, and obviously that’s a story we would seek to cover. Now, we could just have missed that Court date, but checking RG and Sun seems he may not have been sentenced yet, although we stand to be corrected.

    I know both people involved quite well too. I have to say that I feel sorry for both of them. What no one looks at is what made yankee the person he was what caused him to do those “evil” things and last i checked no one ask your family members to get involved with him that was a choice that they made. no one is responsible for the outcome of any ones life unless they kill them.       FridayGirl, judging from this and other comments you’ve made, I think you’re a very confused person…some comments quite lucid and others making no sense whatsoever. As for Yankee…what caused him (and others of his ilk) “to do those evil things” is a little thing called personal choice. He CHOSE to live a life of crime of his own free will, regardless of his upbringing, his education or other hardships in his earlier life. He could have taken the high road years ago and become a contributing member of Bermuda’s society. He didn’t do that and paid for his choices with his life. As for “No sin is greater then another”, that is complete rubbish. Is stealing a pencil worse than committing premeditated murder? As for his relatives, I’m sure they are grieving his death, but at the same time I’m equally sure they all knew or suspected he might one day meet such a fate. And as to your comment “Maybe Cox had a reason to kill him “, I’m sure Cox felt he did have a “reason” to do what he did, but in no way should that justify his taking Yankee’s life.
