Men Charged: Armed Robbery/Sexual Assault

[Updated] Three men appeared in Magistrates Court this morning [Mar.26] charged in connection with an armed robbery at a residence in the Hamilton parish area on March 19, 2012, with one man also being charged with sexual assault said to have happened at gun point.

The three were charged with other offences related to that home invasion.  Because some of the alleged offences can only be dealt with in Supreme Court, no pleas were entered.

A 30-year-old and two 19-year-olds were together charged with entering the house and stealing cash, cellphones, jewelry and other items whilst using a firearm. This charge is indictable only. One 19-year-old man – alone – was charged with serious sexual assault on a female.

Two of the men were charged with two counts of taking motorcycles without the owner’s consent from places in Warwick and in Hamilton Parish; and with a further two counts of using and handling a firearm; and with assaulting a person in Paget. These alleged offences also were said to occur on 19th March.

One man alone was charged with handling a firearm and with handling stolen goods. These two offences were alleged to have occurred on 20th March.

Lawyers Ms Moore-Willams and Duty Counsel L Mills argued for bail for two of the men. Lawyer Marc Daniels made no application for bail for the third. Senior Magistrate Archie Warner remanded all three into custody until April 9th 2012 when they re-appear for Mention. We are seeking legal clarification on naming the two suspects.

Update 12.45pm: The police released a statement saying, “Three men appeared in Hamilton Magistrates Court today on multiple charges relating to two separate incidents that occurred on the night of Monday 19th March, 2012.

“They faced charges of Aggravated Burglary, Serious Sexual Assault, two counts of Taking a Motorcycle without Consent, Assault with Intent to Rob, Possession of a Firearm, and Using a Firearm to Commit an Indictable Offence. All three defendants were remanded in custody as a result.

“Detectives would like to thank all the members of the public who have assisted them during this enquiry. The officers continue to look at other similar incidents in recent weeks to determine if they are linked.

“We recognize that this spate of violent crime has caused concern in the community, however all of these incidents have been investigated thoroughly, and with the continued support of the community the Bermuda Police Service will continue to bring offenders to justice.”

Update 1.15pm: The two men not charged with sexual assault, but charged with the offences related to the armed robbery are 30-year-old Olicie Morgan and 19-year-old Tristan Burgess. The man charged with sexual assault cannot be legally named.

    Heard about it but didn’t believe it… this is outrageous, Bermuda needs to seriously think about gun reform, because when guns are outlawed only the outlaws have them, and ordinary people become sitting ducks, I can’t imagine how the man of the house must feel being forced to watch this happen to his family…

    More steps need to be taken in order to help Bermuda with these issues…..were the hell are the cops? there should be cops in every parish and cctv in regular neighborhoods or at least in the “red zoned” areas.

      Where are the cops? Riding around 3 or 4 to a car doing nothing. My grandson had his bike wrecked at Southside on Saturday night by some little thugs and 3 police cars drove past with not one stopping in spite of them waving for help.After a friend stood out in the middle of the road one car finally returned but did nothing. This was outside the movie theatre where the shooting was a year or so ago.The police think they just need to drive around but they dont help or check on all that is going on.
      I have no faith in the police.

    So the poster who commented on the details on the first article for this story was telling the truth about the assault. Then the posters comment about the nationality of one of these pieces of trash must be true also. The one that is not Bermudian needs to be sent to the worst prison in his country & not allowed to stay here. I’m tired of the people from this country coming to our island & trying to make it like their third world piece of trash country.

Like I typed before this is a detail that came from another poster before any of the information on this crime was released. I thought maybe what his person posted was just speculation but all the details so far have been correct. There are other details this report doesn’t mention that this poster did that are chilling & sick beyond comprehension.

          Its a shame that nothing has been done about the illegal influx of this nationality (not all bad, but a significant % of whom commit crimes – too high a % if you ask me) and the silly Bermudian women who continue to marry snd have children with them. I know of so many who have done this and can only think of two that have NOT run into serious problems.

Anyone would if they saw civilians walking around with automatic weapons in the streets looking like they’re ready to kill anything that moves. We even got robbed by the taxi driver at gunpoint on R&R. Imagine if that happened to you in Bermuda not even a gangster but a TAXI DRIVER. Go to their favorite club in Hamilton & see how they act up like they think they own the place & own this island.

                Weird…. I have been there several times even to a few weddings and never got that feeling. Guess it all depends where you go and who takes you there.

                I guess the tourists who got robbed at gunpoint or who have had their valuables stolen have the right to say Bermudians are violent people right?

                Or the Bermudians that act up while in college in Toronto… it’s fine for Canadians to say that Bermudians are troublemakers etc…

I know what Kenneth Burgess did was very gruesome & violent but he got life for reacting the way some of us feel like reacting to what seems to be injustice. If the twins had been imprisoned on a long sentence for their acts then maybe Kenneth would have felt more at ease & not have done what he did.

    A review of the Jails is needed. Feed the prisoners Bologna sandwiches for breakfast and lunch no mayo or mustard or Cornflakes with cream and water. Make their families or loved onces send money in so that they can have meat on Sundays. Make them wash their own clothes, grow a garden for vegetables and fruit and if you act up you get bread and water for a couple of weeks. No vistors except on your birthday. Goon squad to tear up those cells anytime of the day or night to search for weapons, drugs etc. Foreigners should be sent home and Bermuda spared to take care of them.

    Some Parents and family members need to be held accountable for the wannabe gangsters and nuisances too. Tear up their houses and make them come court with their pain in the A** children. If my children get in trouble the cops would be locking me up for effing my child up for embarassing the family especially if they are brought up right but as they say to “fit in” have to rob and steal.

    If guilty of a crime and a gun used,10 years added on top of the sentence for possession of the gun.

    As someone mentioned here before,the family will have to cough up the money to pay for accommodations at Hotel West Gate for their family member.Relief for the law abiding tax payer.
    Like the Chinese, they send a bill for the bullet used to execute their criminals, to the family.

      Studies have proven that rape is an act of aggression because of inadequacies of the rapist. Its nothing to do with them trying to get sex its to do with them overpowering another person to make up for their worthless existence. Castrating them wouldn’t make a difference because what was chopped off was useless in the first place. Even if let out peckerless they would still commit violent crimes. Its better to either go with your first suggested punishment or lock them up & throw away the key.

      Switzerland’s low crime rate is close to Singapore’s but their laws are not asinine like Singapore’s. Singapore’s laws are old done away with british laws that were outlawed in England because they were formed around prejudice & bigotry. If we went by those laws many people who have not done anything wrong would be severely punished the same way violent criminals are punished. In Singapore they strip alcoholics & drug addicts naked & strap them to a wooden rack & beat them within an inch of their lives. They also imprison homosexuals & people who give hugs. Switzerland’s laws are better for lowering crime rates.

        Maybe you would like to read up on the Judicial System of Singapore and go through the Criminal Procedure Code Section 325-332, before posting your rather severely mis-informed opinions/views on the laws of Singapore. This section lays down the procedures governing caning offences in Singapore.

        And I do believe being an alcoholic in Singapore doesn’t render the person liable for a caning. If that being the case, Singapore wouldn’t have enough space in jail. Lol.

        I have lifted some of the facts from Wikipedia (it is such a useful thing to have around, you should try it some time) and it goes as per below -

        Singapore Laws allows caning to be ordered for over 30 offences, including hostage-taking, robbery, gang robbery with murder, drug use, vandalism, and rioting. Caning is also a mandatory punishment for certain offences such as rape, drug trafficking, illegal money-lending, and for visiting foreigners who overstay their visa by more than 90 days, a measure designed to deter illegal immigrant workers.

        If you are caught drink driving for the first time, you will be fine up to $5000 or 6 months imprisonment and your license revoked. Second time offender, you will be fined up to $10,000 and imprisonment up to 1 year and your license revoked. Subsequently, the court will enhanced punishment up to 3 times the penalty – $30,000 fine and up to 3 years imprisonment and your license revoked. Offenders causing death or serious injuries can also be caned up to 6 strokes.

        Homosexual activity is illegal in Singapore although the law is generally not enforced. In fact, if you were to visit Singapore, you would find that the gay culture has surfaced rather publicly in these years. Same-sex clubs, gay themed nights, are pretty much a norm. So are seeing 2 men or 2 women hugging and kissing and you can definitely see that it’s more than a friend “thing” going on there.

        Perhaps you can quote a reported case in Singapore of people who hugged and got jailed and caned. Because despite living in Singapore all my life, I have yet to hear of such a case. Lol…this would have made a bigger piece of news around the world than the ban of sales of chewing gum in Singapore.

        Last but not least, lest Singapore may be viewed as a Neanderthal, this is part of the caning procedure -

        The cane – a rattan cane four feet (1.2 metres) long and half an inch (1.27 cm) thick is used for prison and judicial canings. It is at about twice as thick as the canes used in the school and military contexts. The cane is soaked in water beforehand to make it heavier and more flexible. The cane is treated with antiseptic before use to prevent infection. A lighter cane is used for offenders aged under 18.

        Administration procedure – Caning is in practice always ordered in addition to a jail sentence and never as a punishment by itself. It is administered in an enclosed area in the prison, out of view of the public and other inmates. Those present are limited to the inmate, prison wardens, medical officers, the caning officer and sometimes high-ranking prison officials to witness the punishment.

        An inmate sentenced to caning receives no advance warning as to when he will be caned, and is notified only on the day his sentence is to be carried out. In the caning room, the inmate is ordered to strip naked and receives a medical examination by the prison doctor to check whether he is medically fit for caning, by measuring his blood pressure and other physical conditions. If the doctor gives the green light, the inmate then receives his caning, but if he is certified unfit for punishment, he is sent back to the court for his prison term to be increased instead. A prison official confirms with him the number of strokes he is to receive.

        The inmate is then led to the A-shaped frame (called a “caning trestle”) and his wrists and ankles secured tightly to the frame by strong leather straps in such a way that he assumes a bent-over position on the frame at an angle of close to 90° at the hip, with his posterior protruding. Protective padding is placed on his lower back to protect the vulnerable kidney and lower spine area from any mis-strokes so that only his buttocks are exposed to the cane. The officer administering the caning takes up position beside the frame and delivers the number of strokes specified in the sentence, at intervals of 10 to 15 seconds. He is required to put his full force into each stroke. The strokes are administered all in one caning session, unless the medical officer certifies that the inmate cannot receive any more strokes because of his condition, in which case the rest of the strokes are converted to additional prison time.

        Medical treatment and the effects – After the caning, the inmate is released from the frame and receives medical treatment. Antiseptic lotion (gentian violet) is applied and the wounds left to heal. Where a large number of strokes is given, there is long-term scarring of the buttocks. Those caned are not eligible to serve in the Singapore Armed Forces as conscripts if they have not already done so.

        Having said all that, it is true that certain sections of the Singapore Laws may be viewed as outdated in this day & age, but our law-makers too, have their views on why the these laws still stands to this day and how it can still be applied. The written law is not a dead thing, it can too, evolve with time and circumstances. Otherwise there wouldn’t be “precedents” for lawyers to refer to.

            Male Convicts Liable for Caning

            A convicted male criminal who is between the ages of 18 and 50 and has been certified medically fit by a medical officer may be subjected to judicial caning.
            He will receive a maximum of 24 strokes of the cane on any one occasion, irrespective of the total number of offences committed.

            If the offender is under 18 he may receive up to 10 strokes of the cane, but a lighter rattan cane will be used in this case.

            Boys under 16 may be sentenced to caning only by the High Court and not by district or juvenile courts.
            The convict will not be caned if he has been sentenced to death.

            The rattan cane shall not exceed half an inch (1.27 cm) in diameter and 1.2 metres in length.

              Caning takes place at several establishments around Singapore, notably Changi Prison but also including Queenstown Remand Centre, where Michael P. Fay was caned in 1994. Canings are also administered in the Drug Rehabilitation Centres.

              From my research Singapore considers alcoholics as drug abusers & the same Rehabilitation Centres for other drugs are for alcoholics as well.

              There are reports that say that wealthy alcoholics & other wealthy addicts in Singapore go abroad to get help because they don’t want to be caned.

A prison official confirms with him the number of strokes he is to receive.

              Wow you must have some extremely healthy inmates in the Singapore prisons if only 5% of the prisoners are deemed not healthy for canning.

              Do you still want to claim these laws as humane?

              The cane – a rattan cane four feet (1.2 metres) long and half an inch (1.27 cm) thick is used for prison and judicial canings. It is at about twice as thick as the canes used in the SCHOOL and military contexts! The cane is soaked in water beforehand to make it heavier and more flexible. The cane is treated with antiseptic before use to prevent infection. A lighter cane is used for offenders aged under 18.

              Are you out of your mind?!?!!? Do you have children? If you do, do you cane your children with a four foot quarter of an inch cane?!?!?! Do you tell them before the lashing that, “It’s okay its a bit lighter than an adult one & I’ve teated it with antiseptic so you’ll be fine.”?

              Also how the heck do you have a law that is generally not enforced? I know if you like a person & their gay they wont get locked up & if you don’t like them you can use the law.

              Now both of us have put up Wikipedia clippings even though Wikipedia can’t always be considered as 100% accurate. So our references may be wrong since I”m sure neither of us has experienced a Singaporean prison.

              Before my information came from an English expat friend who worked in Singapore but thanks for giving me the suggestion to check. As they do cane alcoholics & do occasionally put homosexuals in prison check again I didn’t type caned for that one. Though I have no idea how generally not enforced works but it sounds kind of like some of our laws here but its good to know its not enforced regularly. As for the hugging thing this I’ve not found proof of but my friend told me he was warned of this when he tried to hug a girl he was dating there.

              If you still think the laws are not inhumane you should take a look at a site that is vouched for as totally factual. The Amnesty International site which states that…

              Government critics and human rights defenders continued to be penalized for exercising their right to freedom of expression. The media continued to be tightly controlled through restrictive censorship laws and legal actions against publishers. Arbitrary detention, judicial caning and the death penalty were retained.

              The UN Special Rapporteur on racism visited Singapore in April. He stated that it was time to allow Singaporeans to share their views on ethnicity and work together to find solutions.

              Honestly I feel its fine & right for singapore law to cane hostage-takers, robbers, murderers, rioters, rapist, drug traffickers depending on the drug they traffic & illegal money lenders depending what the money is lent for.

              But I don’t agree with canning drug users, vandals & visiting foreigners who overstay their visa because the crime does not fit the punishment.

              I also definitely don’t agree with caning kids because this teaches them violence is the solution. If you don’t think this is violent then I suggest to get someone older & bigger then you to hit you with a 4 foot quarter of an inch cane on your bare skin. I’m sure no amount of antiseptic will make the pain feel any less.

              Like I typed before Switzerland has a crime rate as low as your country & they’ve achieved this without having to beat anyone with a cane.

                Note that I did not mention WHERE the canings are held but rather the procedure of it. So your mentioning of the places where the canings can be held would be for?

                Alcoholics pose no offence to start with, as forementioned, it is only when a death or serious injury is caused by the intoxicated person then which it becomes an offence.

                Look at it this way, if one is rich enough to afford to be whisked away overseas to receive treatment at some Betty Ford Center as opposed to being caned, who wouldn’t want to take that chance. Unfortunately, not all of us are born with a silver spoon. Neither do we get to choose the country or family that we are born into. So one learns to abide by the rules of one’s country. If you still insist on breaking the rules, then be prepared to face the punishment that is meted out.

                Alcohol is I reckon, a kind of addiction, Betty Ford Center is for drug AND alcohol abuse. So why should rehabilitation centres in Singapore, or any other place in the world, be any different?

                95% of the canings may be implemented but then again, not all are being implemented 100%. As mentioned in my earlier post, should the inmate be deemed medically unfit by the medical officer in the midst of his caning or even before, all or the rest of the unadministered strokes are converted into a longer prison sentence.

                Considering that caning is implemented for male convicts between the ages of 18 to 50, I would dare to assume that people in this age group are mostly healthy to start with.

                There have been countries that assume a far worse stance where crime is concerned. Their people are sometimes not even given the chance to turn over a new leaf and make a better person and life for themselves.

                Caning has so far, proved to be a very successful deterrent, where Singapore is concerned.

                I would, in all probability, cane my child, for a mistake that is very severe, to imprint onto my child that it is not a matter to be taken lightly. And it can deter the child from committing the same mistake again as he/she will remember the punishment received as a result when faced with the same situation again. And of cos, I wouldn’t cane my child as an infant, rather only when my child is old enough to differentiate right from wrong. Putting a child in the “naughty corner” may not be as effective in emphasizing the severity of the mistake made. A case of “spare the rod and spoil the child”.

                Caning a child doesn’t necessarily lead them into thinking that violence is the solution. Not when the caning is justifiable and done in a manner to impress on the child that it is because of what he/she had done wrongly. And not because the parent is just going “trigger happy”.

                Imagine for a moment, IF caning is a form of punishment in your country’s law system in prisons, would a cane that you can buy off the shelf of a convenience store or a feather duster be a successful deterrent when used on adult criminals?

                Yes, I do admit it is an anitquated law against gays and unfair in the sense that it does not include their female counterparts. However the law does evolve, even though the ruling may not have been lifted, it has recognized that such lifestyle choices are a personal freedom. The times when it is possible for a gay person to be put behind bars is when it is reported to the police by someone AND they have been caught in the act of engaging in homosexual activities, or approaching another person soliciting sex in exchange for whatever advantages and that person reported it to the police. Or if the gay person is unlucky enough to have actually propositioned an off-duty police officer (who is not gay and is offended)…lol. And neither have I mentioned that homosexuals are being caned in prison, I had merely stated the possible reasons for a gay person to be imprisoned. Not about caning.

                Your expat friend in Singapore was most probably being joked around with by his local friends, if the girl was someone he was really dating. However there have also been instances when expats in Singapore misbehaved when they get drunk and rowdy and actually go around talkng and hugging total strangers or just mere aquaintances. Some will shrug it off as the “offender” is simply drunk but some might just take offense. Though I am in no way saying that only expats are responsible for such actions…it can happen to anyone who is highly intoxicated.

                Singapore is taking steps towards creating more equality between locals and foreigners but such undertakings cannot be achieved in a short timeframe. There are many underlying factors to consider and how it can affect the society as a whole.

                How does one draw a line between what kind of drugs or the amount of it is tantamount to an arrrest or a caning? So cocaine and heroin is liable? While morphine is not since it can be used in hospitals as a form of pain relief? Illegal moneylenders are illegal moneylenders irregardless of the excuses. How would you feel about having to pay an interest of $300 per week for each week that you fail to pay up the principle amount of $1000 at one shot? And you don’t even get the $1000 to start with cos the lenders already take the first interest cut of $300, so you end up only with $700. There are charitable organizations and government help centers that can offer some sort of assistance for genuine needs.

                Without tough actions to signify the seriousness in which a country takes a crime that is being committed, what would deter offenders to not repeat the same offence over and over again if all the punishment they receive is a slap on the wrist, a jail term or a fine of certain amount?

                Laws and punishment methods that work in certain countries may not be workable in another.

                Every house has its rules, every country has its laws. Who are we to judge if it’s right or wrong? Fair or unfair? Humane or inhumane? Is a death sentence by lethal injection more humane than a shot to the head? Cos ultimately the end result is still death for the crime committed. We can only respect the laws of that country and how it’s being administered and why. And adhere to it when we are in that country.

                  A lot of things can change or improved in a timeframe of 2 years.

                    I recognise that there all many aspects in many areas governing Singapore that require some tweaking, or some finetuning, or at times, maybe even a total abolishment. And that the government should give a ear and heed, or at least take into serious considerations some of the issues that come up during Parliament sessions and address it accordingly. And listen to her people more closely, rather than depend on a general consensus. The government have heard but like what I mentioned earlier, time is needed to make corrections.

                    Not everything can be achieved at once. Not everything can be changed at once.

                    If it is impossible for a person to be perfect in every way, how can one expect a government, any government, to be perfect either. We can only do the best we can and strive to be better and achieve more.

                    Every single person, every state, every country, every government comes with its own flaws. If we can all be that perfect, there would be nothing in the tv news and newspapers besides reports of the weather and natural disasters, happy ever after weddings and obituaries.

    I would like to suggest adopting the 3 strikes law like they lave in California. (3) Crimminal Offences, and the offender is sentenced to 25years to life without parole!!! There will be 1 or 2 that will try it but, when it’s enforced thier attitudes will change quickly!!!
