16-Yr-Old Student Hits Teacher With Trash Can

A 16-year-old student appeared in Magistrates Court this morning [June 26] and was given a Conditional Discharge after he had pleaded guilty to assaulting a teacher by striking him from behind with trash can.

Crown Prosecutor Garrett Byrne told Senior Magistrate Archie Warner that on the afternoon of 10th May, Tristan Hollis was involved in a classroom confrontation with the teacher at the Berkeley Institute. The teacher asked the student to leave the class. Outside the classroom, the student had an altercation with another student.

The teacher sought to breaking up the altercation and while doing so heard the teenager whom he had sent out said: “I don’t f***** care. I ‘m going to kill that boy”. The teacher then felt himself struck in the head by what turned out to be a rubber trash can.

The school called police, the student was taken into custody, and has since been expelled.

    This is definitely a tragedy since the student’s education will be irreparably interupted.

    It is also too bad that we do not know how the parents responded since parents are the primary educators for our children.

    Lets hope there is some intervention before the student graduates to more disruptive behaviour.

    So wait, this student got a conditional discharge? What the hell is wrong with our legal system? You have a student assaulting a teacher. That is expulsion, jail time. This is why they continue to do a pack! They don’t get punished for it.

      I disagree with the ruling as well but I have to wonder if the defence was that he was not aiming for the teacher but the boy and the teacher got in the way? Still no excuse but it’s the only reason I can think of for that slap on the wrist of a sentence.

      Gosh, I feel for teachers having to deal with that crap. It’s not easy…

        Berkeley institute have been having many challenges this school year and in the pasts with their students however, they are excellent at concealing the Daily interruptions and the like at The Berkley… This Type of behavior, It’s in all schools primary and middle, public and private. Correction has been negated and the power has been shifted from adults.Somehow, we as Bermudians need to take hold of our offspring and train,teach,,love and correct them as our forefathers did with us..

      Conditional discharge is a legitimate sentence. It encourages you to be good for a period of time. So many of you just want to penalize. What about rehabilitation? This child maybe able to be salvaged. I would rather do that than have him cost us $80,000 a year.

    When I was in school, if I had struck a teacher from behind with a trash can…I pretty sure I would never be allowed back into that school again. The family must be so proud of their young man.

He had a choice of getting a good education but squandered it…his rebellious or militant attitude might take him farther in the defense forces of bda…idk. As far as im concerned that teacher should have immediately floored that “child”…he’s already shown his cowardice streak by attacking from behind,…you all better nip that s#!t in the bud right now or forever watch your back around him. While he was on his back trying to focus his eyes thinking that he’d never do that s#!t again. Expelling him is not good idea…you just graduated him into the streets. Bring in these boot camp type motivational speakers that could fold them up and wipe their azz with them…guys built like brick sh!thouses, with an attitude to match…and Nooooooo mommies in sight.

    A good cut-a** in de stocks down St George’s for stupid crimes like this n similiar ones. To lock up these clowns is a waste of good tax payers $$$….     Conditional discharge is supposed to mean that the person better not get into any more trouble for a certain period of time, usually 1-2 years, otherwise, not only will they have to do time for the new crime, but also have the time they could have done for the old crime factored in. It is supposed to be a deterrent. However, recently those with conditional discharges who have been brought up on new charges do not appear to receive any more drastic sentences.

    Chief Justice Kawaley, I do hope your review is having a look at these cases.

    Jail should not be the answer. This young boy should be given community service, anger management class and sent to Bermuda Youth counsellors Dept. plus be made to enroll back into another school.

    You can train your child as much as you like and bring them up well with good values, but sometimes they do stupid things or say stupid things, and at 16 it is difficult to say how much control you have over them.

    Now, how to react to that. Is that person normally well behaved and that was out or character, is that person having psychological problems or problems at home at the moment, is that person a well know instigator of trouble, is that person someone who hangs around with gang members. Add variables to that.

    Whilst I agree that assault should be punished and is never acceptable, really you should all think about appropriate punishment given the circumstances (and I am not saying let him off as I do believe that you have to be taught that actions have consequences). However, lots of people including myself did very stupid things during adolescence.

    Surely, some of the folks here are completely overreacting. There is nothing in the article to suggest that the teacher was actually injured and it appears that the rubber trash bin was intended for the other student involved in the confrontation – not the teacher.

    Calling the Police prevented this incident escalating, and in the meantime the school has taken strong action in expelling the student. We know didly about this young man’s behavour prior to this incident so it’s unfair to now criticize the school for expelling him.

    Yes, a conditional discharge may sound like a weak sentence, but it means that if this kid gets into any sort of trouble again during the period of his conditional discharge then he’s in double trouble and can be sentenced for this assault.

    These days we seem to be very quick to condemn everyone, and here’s a case in point. These nameless bloggers are knocking the Magistrate, the school, and the kids parents with more vitriol than the culprit appears to have used during the incident itself.

    I taught this young man this school year and unfortunately he is a train wreck that has been derailing for quite some time now. The teacher sadly was injured. He has had several people in the community trying to work with him – pastors, counselors. Although young he wants to be ‘about that life’. Not in a gang, but wants to associate. I care about him but have already told him that I won’t be visiting him when he is incarcerated nor will I give him spare change when he is begging on the streets! He doesn’t want to be a ‘nerd’ although he has intelligence and could be successful if he cared just a little. He is looking for acceptance, popularity, acclaim but from all the negative sources. Lastly, his family life has greatly contributed to his downward spiral, so it is quite sad on both fronts. His behavior is inexcusable, but he is a product of his environment.

    Yes, some teachers have to put up with a lot!

    Two DUI offenders get to keep their license when they should have taken away for a year.

    How is that a deterrent against doing it again?

    countries, i.e. third world, to do community service, building houses for humanity, perhaps if they saw what the ‘Real World’ is like they may appreciate living in Bermuda far more!

    So we have a young man who has been expelled from school. If he has not been enrolled in another school he has been turned to the streets. We are so comfortable in judging parents that we do not know. Sometimes we as parents do the best we can only to have our children go astray.

    I would have preferred that the judge recommend some sort of counselling or anger management course. We need to stop these types of behaviour but jail is not always the answer.

    We are so quick to judge based on a news story without all the facts. This young man may have used violence with his hands so many of us who blog use violence with our words, both cut hard and deep.

    Another curious one from Warner! But what about the DPP?? Is he Appealing the sentence?? If not, Warner now belives even the DPP thinks the sentence was correct and no Apellate Judge can correct it! Without deterrent Sentences,these young men disrespect all and fear nothing! Some of these children have become immune to licks, and some parents have resorted to giving” time out” but either way the punishment should fit the crime. If we as parents refuse to correct,refuse to open our eyes and ignore what our children say and do to us or any person ,who’s to blame! The generation of today feel entitled to everything. Their logic is that they did not ask to be here so give me what I want , sadly parents do just. When they get into trouble they say not my child… Adults are being pushed aside by their children and the child isn’t afraid … Something needs to be done!

    Look at the amount of young teens who have had children a pawned them off on their parents and grandparents, who are physically and emotionally drained, because their own child has run amuck. Generation after generation over the years have declined in integrity, morals and respect . This incident is just one of many more to come. Take heed , people we must regain our families and community …..STEP. UP!

    Once the Mega Schools came into place everything went down hill. It seems like people are in Denial. The first year of the Mega High school coming into place I can remember 6 young man who where expelled from this same school. So that tells me that teachers where never prepared for these large numbers to a classroom. Also we have to remind ourselves that not everybody up bringing are the same. We have kids raising kids, mothers and fathers using and abusing drugs and the list goes on. So before a child can be expelled we need to ask ourselves even though one might need angermanagement what has cost this problem. EVEN THOUGH I KNOW there are some teachers that are willing to help remember we also have people in place who think just like kids and taunt and torcher them because of a family member they may know. So what happens next a kid then becomes labelled off of hear say. Any way I can go a long way with this subject but we also need to ask who took disicpline out of the schools and homes, by doing that you have made children feel they have the right to direspect because this is what we have allowed. I just hope in September the Government notices this is a big problem in this Island and try to fix it.
