Private Citizen Detains Thief Until Police Arrival

In Magistrates Court this morning [Feb 18], Magistrate Khomisi Tokunbo sentenced Jason Liburd to 12 months in prison, with the Court hearing he had been caught in the act of stealing by a member of the public who detained him until the police arrived.

On 14th February 2013, Liburd had been caught by a man who was returning to a workshop and noticed that the workshop windows and screens had been damaged. He determined that someone was inside the closed shop, so he called the Police and waited.

A man – later identified as Jason Liburd – emerged from the Angle Street workshop, was stopped by a private citizen who grabbed and detained Liburd until Police arrived.

At Hamilton Police Station, Liburd, 42, admitted breaking and entering and stealing a variety of Caribbean Island’s flags, necklaces, pendants, and emblems valued at $559.

After pleading guilty to the single charge, Liburd said that he had been passing by when he saw two guys in a car who had scared him. He said that to escape them, he had gone onto the property, entered the shed, saw stuff that he liked, and had put the items in his pocket.

Liburd — who has a long record of offences — was assisted by Duty Counsel Susan Moore-Williams. Liburd told the Magistrate: “I admit I was wrong for taking the stuff. I go to my meetings and I take my medicines and stuff.”

Magistrate Khomisi Tokunbo sentenced Liburd to twelve months in prison.

    Didn’t this guy get 12 months in September 2012 for a May 2012 crime…. if so, how come he is back on the streets so early and why isn’t this sentence longer?

      but any early release time i.e. time not served should be doubled and added onto the end of their new sentance Automatically. An incentive to not mess up again.

Killing off the Americans roaches as you but them would completely destroy your little island. its pea minded people like yourself that are destroying what once was a beautiful island with some of the most polite people I have ever met.     Can you please explain how the book of rules, makes all Bermuda look like fools……
    For the life of me, I have seen one too many “smack on the wrist” for offenders and more so second and third offenders with time meted out like a reward for the breaking of the law/ invasion of privacy/ physical abuse/ gun crimes/ child molestation / DUI/ money laundering and the likes. Just what powers is one able to use to sentence these offenders. It is quite obvious that these laws are truly antiquated and needs the most serious line of revamping.
    The court system has a flaw within it and surely these repeat offenders know the deal and certainly not bothered if they should get caught. Only to come out of Westgate with their next target perhaps, already lined up. I just hope that the Minister of National Security will address these lacksadasical, non applicable, “smack on the wrist” laws that hold no water and totally unacceptable in the new era we find this island in. Enough is enough and certainly this is enough. Every victim will have to concur that the courts response is more than totally unacceptable.
    The incarceration at Westgate Correctional Facilities, I assume is parallel with those staying and paying at the Fairmont Southampton or The Reefs. The only difference is the guest pay their bill on check out and the luxurious inmate gets renumerated when they check out. Imagine that.
    Get tough Bermuda as it seems the “offenders” legal and illegal are sinking our island home…….S. O. S.

    Jason is the quintessential neighborhood pest. I remember years ago how he used to harass me unmercifully. I decided to turn the tables on him and use my favorite tactic, reverse psychology. One day, as I was waiting for my bus he started up again.
    Turning to look him straight in the eye, I cooed, “You know, you are exactly what I’m looking for. A big, strong, hard-working man to help take care of me and my five children.”
    “Five children?!!” he exclaimed. “I didn’t know you had all those kids.”
    Well, did he make a hasty retreat! Whenever I saw him after that, I would call out to him but he would act like he didn’t see me. I guess he figured it would take a lot of housebreaking to support an instant family of six LOL!!!
