Live Blogging: Bermuda Liquor License Debate

774291_bar_1[Update: Bill effectively passed] Today in the House of Assembly Bermuda’s Liquor License Act 1974 is being debated, with amendments discussed including ratio of security guards to patrons in nightclubs, mandated training and allowing the Police to close a nightclub for 24hrs if they feel it is in the best interest of public safety.

Minister Zane DeSilva [PLP] read out the statement, saying “they are all mindful of the sensational violence confronting our justice system”, and they must look at “indirect corresponding measures” which lead to reviewing the Liquor Licence Act.

He went on to say that “excessive consumption” offends “public morality” and that illegal sales will not be tolerated. He said that the concept is to strengthen the legislative framework, and said they researched other jurisdictions, consulted with CADA who provided a report, as well as consulted with other entities.

Measures included:

  • Ensure that holders of nightclub licences maintain an appropriate ratio of security guards to patrons. Up to 50 persons, 2 guards, and 1 guard for every 50 persons after that.
  • Mandate appropriate training for persons in charge of bars and nightclubs
  • Premises with a DJ or music after 10pm to have a security guard
  • Give the Police [Superintendent or above] necessary authority to close premises for a period not exceeding 24 hrs if they deem a threat to public safety.
  • 48 hr waiting period for persons to take advantage of aspects of member club, with the President or Secretary held liable if the rule is broken.

2:05pm: Trevor Moniz [UBP] says the UBP supports the bill, references past shootings at Court Street nightclubs over the years and the Easter RAA shooting. He says he doesn’t want to put “draconian” measures on business owners, and put therm out of business. He calls for more CCTV cameras.

2:16pm: Dr Grant Gibbons [UBP] talks about concerns of his constituents in Paget, mentions White Sands Hotel parties saying people park all over the place and that you get some “anti-social behavior” happening, people shouting and cursing etc. He said there needs to be more thought for residents.

2:19pm: Wayne Perinchief [PLP] speaks to the tie-in of night entertainment, liquor and tourism. Says he himself likes a drink now and then, and that he knows other members of the House enjoy “fine wine”, some laughter can be heard. Says he wonders if our approach to alcoholic is “archaic”, and wonders if we should loosen some prohibition. Points out Bermuda used to make money “running alcohol into the USA” during their time of prohibition. Says he is not saying “that’s a good thing, but it was a lucrative thing”.

2:34pm: Dame Jennifer recognized the presence in the gallery of the Chairman of CADA Anthony Santucci, who released a statement saying he welcomes the debate.

2:35pm: Kim Swan [UBP] says he supports the Act as a first step. He references the 48hr member provision, saying he is “not sure how workable it will be”.

2:44pm: Ashfield DeVent [PLP] speaks, says it is clear everyone is in favour, says people just have to spend some time on a Friday night on Front Street or other places where parties happen to see why this Act is needed. Says we “can make all the laws we want, but if there is no respect for the law” it doesn’t do much. Says he supports the Bill fully.

2:51pm:  Zane DeSilva [PLP] speaks, says it is a pleasure to hear everyone agreeing, not just on this amendment, but the earlier PACE amendment.

3:01pm: Wayne Perinchief [PLP] speaks to the members bill, mentions three sailing member clubs, says they entertain foreign sailors. Says the clubs are all well regulated, speaks to “practical aspects of application.” Asks about large concerts [with say 1,500 people] is the security guard ratio still applicable. Says as a former Police Officer sees practical issues for the Police with enforcing the law.

3:08pm: Trevor Moniz [UBP] speaks to rules regarding member clubs, says they have guest options. Wayne Furbert [PLP] and Kim Swan [UBP] also speak on various issues of practical applications.

3:27pm: Bill reported to the House, and effectively passed
