DUI, Damage & Assault: Suspended Sentence

In Magistrates Court this morning [Feb 21], before Magistrate Juan Wolffe, 27-year-old Randolph Hall of Cox’s Hill, Pembroke was today fined a total of $2,250 and given a three month jail sentence – suspended for twelve months.

The punishment arose from two traffic offences, one charge of assaulting a police officer, and one of causing willful damage. Mr Hall pleaded guilty to all four.

In the DPP’s statement of evidence, on 18 February 2011, Mr Hall was caught riding a motorcycle on Southside Road. When stopped, Police had reason to believe that he had been drinking and also found that he had been recently disqualified from driving all vehicles. A breathalyzer test confirmed that Mr Hall was over the legal limit.

At the Police Station, the Police alleged that Mr Hall had assaulted a Police Sergeant. In his defence, Mr Hall said that after being asked to remove his shoes, he had done so. Mr Hall said that he threw the first shoe at the Police Sergeant who caught that shoe. Mr Hall went on to say that the second shoe had hit the Police Sergeant in the face, but that this was not intentional.

On the willful damage charge, Police alleged that Hall had pulled the mouthpiece from the breathalyzer, saying: “F&%k that. Police also alleged that Mr Hall had blocked the toilet in the holding cell and had then flushed the toilet several times causing it to overflow.

Mr Hall’s explanation to Magistrate Wolffe was that he had vomited into the toilet, had tried to cleanup himself and the immediate area, and had put everything down the toilet after which he had flushed it normally; but the toilet had blocked itself.

Admitting that he had a drinking problem, saying that he was now working for the first time in months, that he was a good father to his child, Mr Hall said: “I accept full responsibility for all my actions.”

Recognizing that Mr Hall had been disqualified just seven weeks earlier on 7th January 2011, the Magistrate imposed a total fine of $1,750 for the two traffic offences; a $500 fine for the willful damage charge; and a three month prison sentence, suspended for twelve months, on the assault charge.

    And a recent individual goes to jail for 18 months for hitting someone while drunk….a horrible thing to do and should do time….and this guy gets off for this…DUI while disqualified and assaulting police…double standard?
