19-Yr-Old Jailed For Driving While Disqualified

July 18, 2012

In Magistrates Court this morning [July 18], after being caught driving whilst disqualified for the second time, 19-year-old Brandon Madeiros found himself being sent to serve 30 days in prison.

Mr Madeiros had been disqualified from driving until 23rd October 2012. On 15th July, Police stopped him, and at this time, Mr Madeiros admitted to the Police that this was the second time that he had been caught in breach of this particular Court order.

Asked to explain his action, Mr Madeiros told the Senior Magistrate that: “Somebody asked me to bring something for them. I made a stupid decision.” He went on: “I know that I can get 30 days in prison for this.”

Senior Magistrate Archie Warner told Mr Madeiros: “I told you that if you came back a second time you could go to prison. You were warned. You acted in arrogance and contempt and you challenged the Court. You’re expecting 30 days – you’ll get 30 days.”

On hearing this sentence, Mr Madeiros made a loud appeal and asked the Magistrate to either lengthen his disqualification or impose a heavy fine and not send him to jail. The Senior Magistrate did not reply and the duty Police officer beckoned to Mr Madeiros and led him off to go through the grey door.

I wish all judges would do the same!

  2. Guy Carri says:

I don’t disagree with the sentencing, BUT you do this and act all harsh for a DWD but for the serious crimes it’s a slap on the wrist. What is wrong??!!!

  3. Swing Voter says:

should increase the fine to $5000….if he or his parents can’t pay on the spot then lock him up….shyt Warner, its gonna cost the tax payer 7K to take care of his silly azz for one month…..you let other ppl off for worst offences.

    • I AGREE says:

Could’ve pumped money in Gov. His gone in Jail for bike offense and may come out a junkie. Who the hell wants to go jail, wise up men surely life is good. Bondage is utter stupidity!!!

  4. young lady says:

    i agree

  5. Hang in Brandon, cant believe the judge jail u for that.(smh)i guess if u were in a gang & hung with the right guys, u would be a free man 2day.

    • Liz says:

Thank you. six people where sent to jail for the same offence why are they blowing this up! Setting an example. Well Mr. Police man you need to stop everyone then and ask for their lic. I bet 1/4 of the people you stop will be doing 30 days.

  6. stupid ppl! says:

‘swing voter’ you have no right to judge him, you were never in his shoes and you dont know the truth on why he need to drive that night! you wouldnt dare say that to the young man personaly, you feel all mighty behind a screen if you have an issue go to the court ! speak how you feel if not, shut up !

And yes I would say this to u and his face… And unless your name stupid ppl ya doin the exact same thing… Hidding behind a screen name… Get over yaself no one puts their name! • Liz says:

I am not hidding behind a screen name and once again it had to do with his so called girlfriend do the math and due to what occurred you would probably understand why he got behind the wheel they say love is blind and can make you do stupid things.

  7. The Defender says:

This act of defiance warranted a stronger consequence than a fine. Well done Justice Warner!

    • Politely Pompous says:

I don’t get Justice Warner…people do a LOT worse and he lets them go with a fine or suspended sentence.

The defendant should have just started crying and told Justice Warner he had a sick grandmother to take care of-that one works every time with that particular judge.

  8. Duh says:

    This dont deserve jail time!

  9. Unbelievable!!!!!! says:

R u serious . . . 7K for the tax payers to pay out!!!! Have the judges ever heard of a heavily hefty fine and community service. These are minor traffic offenses . . . GEESH!!!!!

  10. Betty Swallocks says:

    Asinine judgement IMHO. Simples.

  11. true dat says:

What?!! i am so confused so like why did he have to go to jail??? This is ridiculous!!

    • chris says:

It could have something to do with breaking the law… Twice… But who really knows

  12. Triangle Drifter says:

Yup, $7000.00 in lew of jail time plus extend the suspension. That ought to give him something to thnk about. Westgate for a non alcohol, non dangerous driving offense is harsh. Most likely will cost him his job too. His employer is penalised now that he has to look for another employee.

  13. Keepin' it Real...4Real! says:

Hold ya head high Madeiros…chillax for a month an catch up on some sleep…make them dumb a$$e$ pay for you, for putting you there….and my portion that i will pay only pisses me off more at them who want you there.

    • chris says:

“I told you that if you came back a second time you could go to prison. You were warned.” Sounds like he wanted to go to prison… Dumb a$$

      • Liz says:

dumb a$$ i bet you ride or drive if you have a car while disqualified he was not behind the wheel either times he was standing right next to his girlfriend do the math dumb a$$!!!! Don’t know don’t tal. Get a job

      • Liz says:

Mr. Chris you must have never been in love or it might be simply you dont know how to treat a young lady. Which is it? Clearly when it comes to matters of the heart you nothing about it. You see love makes you do crazy things like get behind the wheel of a car even though you are not suppose too. He broke the law like so many of us do everyday and know he is paying the price over a TRAFFIC OFFENCE!!!!!!!!!!!!!!!! You must be a friend of the girlfriend hmmmm no wonder you are calling him a dumb a$$!!!!

  14. Liz says:

This is a simple traffic offence which most of us have broken. Do you wear your seat belt, do you talk on your cell phone, do you play loud music, is your tint legal i could go on and on. So do the math before you open your mouth. He is a strong young man and this will not break him. He has people that know exactly what happened and why he did what he did. His head is high and is doing just fine. He did not hurt anyone but himself. So people please save all your BS comments to yourself clearly you have nothing else interesting to do with your time. The only reason I am reading these comments is to see how many stupid people are there in BDA gossip gossip gossip. Hang in there Brandon you are much loved and have alot of support from the people that know the TRUTH. You were honest and answer the police when asked both times. Head high head high.

  15. Poetic Justice says:

I see some are so ready to dismiss this as a minor offence that should have been treated with a lighter sentence, but take a second and look around you at the state of our country people. We live in a lawless society, nowhere is this more evident than on the streets. People are prone to breaking every conceivable law of the road and then this in time transfers to other offences till such time they figure “I can do as I please to hell with you”!! (BANG, BANG) What exacerbates the situation is the police cant be there to ticket every fool who double parks, runs stop lights, dives while suspended etc in most cases with their children in tow so we are creating another generation who at a young age have no regard for the laws of the land or those who enforce them. I say stupid is as stupid does; don’t want to do time don’t do the crime. Simple. I agree he may find himself in the line of unemployed but who do we blame for that? Stop enabling people and encourage them to take responsibility for their actions for the sake of the country and future generations.

    • Liz says:

Really all of you are clapping your hands and calling him names like stupid and a$$ you must have never had a few drinks and have gotten behind the wheel and drove off. By the way that is breaking the law alot worst then what he has done. So speak if you have never broken a traffic offence. He put his girl before himself and because of her pricking because she wasnt getting her way he is locked up and she is parting like a rockstar. I hope you forget her by the time you come out and find someone that really deserves a young man like you!
