Misick: ‘My Human Rights Are Being Violated’

In a hand-written 16-page letter [PDF] from a maximum security prison cell in Brazil, former Premier of the Turks and Caicos Islands Michael Misick says his human rights are being violated.

The Turks and Caicos Sun reports that Mr Misick said he has temporary political asylum and is therefore being detained in violation of his human rights.

He has called on the Turks and Caicos Islands government, the British government, Latin American governments and Caricom governments to intervene on his behalf.

Mr Misick also said he is imprisoned due to the British Government persecuting him as he seeks independence, and he would like to return home to clear his name if he can be given a fair trial – which he says the British government cannot conduct.

Mr Misick was arrested in December 2012 at an aiport in Rio de Janeiro, after leaving the Turks and Caicos in March 2012 following an arrest warrant being issued for him.

Following allegations of widespread corruption in 2009, the UK imposed direct rule on the Turks and Caicos Islands and power was transferred to the UK-appointed Governor.

A number of high ranking people were arrested, and Mr Misick avoided arrest by fleeing the jurisdiction. The UK recently handed back power to the island, and the Progressive National Party returned to power after winning the General Election.

    Having had a look at the letter, I think I understand why there are no comments here. Difficult to believe that missive was written by one who was the Premier of a country, no matter how small.

    So he was being persecuted because he wanted Independence? Stated position for the UK government is any of the Overseas Territories are welcome to go independent if supported by a demonstrated clear majority of its citizens.

    I think it likely the truth is he wanted Independence because he was afraid that he would be prosecuted for his crimes and that in an independent TCI he would be able to control the police and judiciary. This he could not fully do with the British Governor having final say in those areas and of course that was what finally brought him down.

    I think that Brazil is entitled to make up its own mind about allowing him to keep or rescind any temporary asylum. The man is clearly a flight risk (given he was nabbed at the airport) so it is prudent to keep him locked up in some fashion. As to the conditions he is experiencing – well he picked Brazil, which is not know for “cushy” jails. None the less he will be afforded the chance to make his case at an extradition hearing where he can convince Brazil of the merits of his position and any lacks in the request for extradition to his homeland. Perhaps he would have had more luck in Argentina, I think they are still mad at the British over the whole Falklands (Malvinas) Island thing.
