Three Men Sentenced For Gang Attack

October 8, 2013

Kyle Daniels-Smith and Sanchea Douglas re-appeared for their sentencing hearing yesterday [Oct 7]. For their part in the 4th August 2012 gang attack on a man in Rambling Lane, Justice Charles-Etta Simmons handed down a four year custodial sentence on each man.

The fourth man to be sentenced was Judah Roberts, 16 at the time of the attack and now 17. He was sentenced to the fourteen months he had already served and two years probation.

His probation conditions require him to be under a 9:00pm to 6:00am curfew at his residence for the first six months; abstain from alcohol and illegal drugs; submit to random drug tests; and not leave the Island without the permission of the Supreme Court. He is also required to stay away from persons known to engage in illegal activities.

All three read statements from the dock. All three apologized for their part in the brutal attack. All three claimed that the fourteen months that they had already spent in prison had given them time to think and reflect.

In the hearing, Roberts was identified by the Crown as the person who struck the victim on his head with a bottle. Though he still denied it, Daniels-Smith was identified as the person who struck the victim with a 2 x 6 and who had robbed him of cash. All four had been drinking that day.

In referring to their antecedents, their lawyers pointed out that both Daniels-Smith and Douglas had first become enmeshed in the Court system as defendants in their early teens. Douglas at 13, Daniels-Smith at 14.

The victim still suffers from headaches, memory loss, has speech difficulties and had to be flown out to an overseas hospital for specialist care not available in Bermuda. The victim was set upon by the group, beaten with a piece of lumber, hit with a bottle, and kicked and robbed of his gold chain, bracelet, and earrings while his ten year-old son looked on.

In his victim impact statement, the man said that as a result of this criminal act, he had sent his two Bermuda-born Bermudian sons, 11 and 5, to live overseas and neither son showed any desire to return to live in Bermuda.

Another man involved in the attack, Sergio Robinson-Woolridge, has already been sentenced to seven years.
