BIU & Ministry To Meet Over Suspended Driver

[Updated] There is a temporary interruption of bus services this morning, as the BIU called a meeting for bus operators at 10:30am today [Aug.15].

A DPT spokesperson said, “The Department of Public Transportation [DPT] is advising the public that due to union activity this morning there is currently an interruption of bus service, which is affecting all bus routes. The DPT advised that it will update the public once services have resumed.”

The BIU is presently embroiled in a dispute with the Transport Ministry over the suspension of a bus driver. On August 11,  BIU President Chris Furbert said the BIU gave the Transport Ministry 24 hours to reinstate a bus driver who was suspended following an accident seven weeks ago, and the Ministry of Transport released a statement saying the bus driver will be reinstated after she takes a drug test.

Update 11:35am: The meeting is still ongoing

Update 12:20pm: A few drivers are straggling out, however the meeting appears to be ongoing.

Update 1:00pm: The meeting appears to be winding down with drivers walking out and getting back on the bus. We have not had an official statement from any party at this time as to what is happening, however a few bus drivers did say they are going back to work.

Update 1:22pm: We are awaiting a press conference with BIU officials.

Update 1:32pm: BIU officials confirm that the drivers are going back to work right now, and the BIU will meet with the DPT management and the Ministry of Transport. They still hope to have the female bus driver reinstated by the end of the month.

Update 7:30pm: Statement from UBP MP Kim Swan:

As work stopped today for consideration by Department of Transportation (DPT) Workers to go on strike, if ratified at this time, would send out the wrong message locally and internationally, as many of our businesses are hanging on by a thread and our tourism industry limps along.

We urge the union, its members and the government to further consider the current state of Bermuda – engulfed with difficulties economically and socially – to find a solution at the bargaining table or by mediation in the national interest.

When considering the impact of industrial action to the tourism industry, cruise ships have become the main stay for our struggling tourism economy, as more than 55% of our tourist now come to Bermuda via cruise ships. Industrial action resulting in work stoppage of buses will adversely affect tourism and our image overseas.

Consider the rocky start to our tourism season – when issues regarding public transportation in Dockyard resulted in complaints and negative publicity internationally – kicked the cruise season off with prolific bad press.

At this time, midway into the same season, any disruption of service caused by a labour dispute, will place an already challenged tourism industry under further strain. From a local standpoint daily work commuters dependent on public transportation (bus service) will also be inconvenienced and bear the brunt of the work stoppage.

We note that, at the heart of this dispute is drug testing and continue to call on the Plp government to encourage its politicians to lead by example and subscribe to random drug testing.

We urge the Government, the Union and Workers to work expeditiously and with all deliberate due diligence to prevent this dispute escalating to a prolonged work stoppage.

        Forget the bad workers part….would you feel safe on a bus knowing that this union has historically protected drivers of buses and ferries that have been found to be under the influence of drugs and alcohol…WHILE on DUTY!!! 0 fired to date I believe. I would never allow my children to ride on a bus or ferry even on a school field trip because you never know who or what you are going to get.

          Ubnionfreak is correct. Being in a union gives you certain protections and perks but does not allow you to be or act in an irresponsible manner. Just because the union would provide lawyers and arbiters does not allow you to act any way you want.

    Thanks Bus Driva for your feed back. So I can assume that there are others who feel the same way. Is there something keeping you and others who have similar sentiments from continuing your bus runs this morning? I’m having a hard time understanding why you would still not drive even if you disagree. Furthermore…do these Unions get paid even when they strike? If so, that needs to be the first thing addressed during deliberations. There should be zero or half pay for striking to ensure that arbitration is used to the fullest extent. I’m sure it will eliminate all the frivolous downing of tools that is becoming very regular in BDA. It’s like the story when the lil boy cries wolf. Its done so often that when real collective issues arrive the union will have NO credibility left!

      Whenever there is a work stoppage either for a meeting such as this or a strike you will probably find half the bus drivers just sitting over at ptb waiting for service to resume. Unfortunately even for all those who dont agree with the action being taken now and as much as lots of them would like to be out here servicing the public ptb managment wont allow them. Because after a meeting is called everyone has to stop thats the unions policy and if any of them were to disregard that policy there ould be a big price to pay, meaning those who worked might get thier tires slashed from coworkers. As far as being paid most times they are,nt paid for the time lost unless the issue clearly points to management being at fault. But as most have said the minister will back down and again they will get thier way. I remember some years ago the president for the bus drivers devision Glen Simmons called in sick to work so he could go and play in a golf tourament and the team he was playing on won and his picture ended up in the newspaper the next day he was fired the union fought and got him back his job now he is the president of that devision and loves loves loves to recommend strike for every little thing.Its time for our government to take a stand and show chris furbert that they were the ones chosen to run the country not him.

    Its time we privatise the ferry and bus service so we can have service when the cruise ships are in and when we need it. In the mean time..make the woman take the drug test and get back to work. Not only is this disrupting travel for the Bermudian public but also for our soon to be “dwindling cruise ship passengers” (do to our bus and ferry decline of regular service situation). The bus drivers are also loosing wages and in the economy who can afford that!

      Agreed. Seems like BUI is living in the dark ages, trying to leverage their position by making tourists wait for ever for a bus. As we aren’t able to get a rental car, and bikes are for the birds, its shanks pony for us today! Luckily we like to walk, though both in our 60s.

      Has anyone heard of the power of social media? Faster than you can say knife, the bad vibes spread rapidly today when any product fails to live up to expectations, and that includes tourism.
      I could say more, but draw your own conclusions. We live in a highly competitive networked world today, where restrictive practices are dealt with by market forces.
      As to the issue in question, if the driver is clear, let her take the test to prove it. If not well she has to go, and good luck getting driving work after that!

    heres the answer, fire the driver, and replace the BIU. is there a place where we can sign a petition to get this to happen so that we don’t have to worry about this irresponsible driver (and others to come in the future) nor the people who defend them?

    The BIU needs to grow up and be realistic, how can you even entertain this foolishness. This “employee” was told to take a test after an accident, I take the bus and I sure as hell dont want an impaired driver with my life in her hands. She needs to take the test, whats she so afraid of?!

    I hope the Minister and manangement of PTB do NOT back down and make her take the test or let her go. Enough is enough.

    The BIU is the equivalent of a spoiled child who always gets his way. He knows it so he continues to behave badly. Until the Government stands up to BIU, the behavior will continue and only get worse.

    PLP – this is your moment. Don’t disappoint us yet again. Remember, the behavior will only get worse with each incident. Bermuda needs you to stand firm and have the BIU back down.

    I feel what everybody on here is saying. Fact is that the requested drug test is not the one that is part of the employee agreement (if I am correct). They want to take one of those hair sample tests, but the documents in place say it is supposed to be a urine sample instead. My guess is that the point the woman and BIU are trying to make is that if you let it slide for such a minor thing, then what will be next to slide? The end result would be that your basic rights as a bus driver or whatever else you may be would be compeltely ignored as well. Just my projection of what i think the point they are trying to make is.

    Not saying that I agree with the whole strike and all of that, but if I was in her shoes I would prob refuse to take the test as well.

      I could show you or post the drugs testing policy of dpt and nowhere in that policy does it say what kind of drug test it clearly states random drug tests and drugs test pertaining to accidends with injury. The bermuda hospitals board have the same tests in place.

      Seems like we are getting two different stories. I was under the impression that she was in fact asked to take a urine test at first, but refused to do so. I thought that the only reason they are now asking for a hair sample is because one, she didnt report the accident on the day of (a Friday), she call in sick Saturday and Sunday and then on Monday when asked to take the urine test, refused to do so resulting in her being suspended. They are now asking for a hair test because the accident took place over 2 months ago; I believe canabis residue only stays in your urine for up to 30 days, (I could be wrong). PTB is just trying to make sure that drugs was NOT the reason or contributed to the accident whatsoever. Again anyone could have forgotten to put up a hand brake… what makes a huge difference is whether you are sober and forget, or under the infulence and forget….

      Well, if she would have done the urine test when they asked then she would not be faced with having to do the hair follicle test. The employer followed procedure but this womans actions is what cause this situation. I hope they do not strike on behalf of her because it is sending the wrong message to the children. They will think that they can do something wrong and get away with it and have their co-workers all stand up for you. I say they should fire her. Bermuda needs workers who will be truthful. I knew if I did drugs and they asked me to take a drug test, I would do it and pray to God that they do not fire me, instead of avoiding the test and making them think I do it. Either way it would be point towards me being a addict. If I take the test, they will know, If I dont take the test, they will know anyways. Just take the test.

    Bermuda’s bus service is advertised in all the tourist sites as a very reliable way to get around the island. Unfortunately, this is not so, as this morning’s disruption proved. Why couldn’t the bus drivers have had their meeting on their own time? As buses are the only option available to older tourists, we definitely won’t be returning to the island to vacation and will not recommend it to others.

I wish there was a way to have a privately run bus service, then maybe they will feel grateful to be employed and maybe take more pride in their jobs. I truly dont beleive that all of them are so selfish and spoilt adults, but the majority are.

    Competition is always healthy encourgaes one to want to do better so they can prosper. Again, the Minister has to stand up to the wicked (BIU).

    The BIU are so past dumb, its not even funny. I can’t believe they would hold a meeting at 10:30AM instead of 7:00PM as advertised before. They have NO respect for the people of Bermuda and this is because ONE person refused and still refuses to take a drugs test. A test, that even if she tests positive isn’t fired.

    BIU have lost their minds and loose in credibility EVERY DAY. I’m happy the government didn’t budge this time.

    I wonder if there is an insurance apsect to all this. If this female bus-driver has an accident in the future, will the PTB find that their insurance will not cover repairs (including injuried people) due to the fact that they do not/cannot enforce their workplace drug-policy.

    If our people want to make a difference, stop taking the buses for a month. Give the folks a ride… Cripple them for a while and trust me, things will change quickly.
    There is no Union more powerful than empowered Bermudians getting fed up with a broken system. We will lead by example! As our mother said “I can show you, better than I can tell you!”
    Don’t buy bus passes and put the money in the drivers pocket. Now the drivers can have as much time off as they like.

If we sold off the Garbage Government Workers, the Ferry government Workers and ofcourse the largest part of our Budget; Works and Engineering.     Because like most people here the UK is ALWAYS RIGHT. ( haven’t they been rioting the past few weeks )
    Bus strike halts 43 London routes. Commuters struggled to board the crowded services which were running Drivers of 750 buses in east London and the City have gone on strike, halting 43 routes and disrupting 15 others.
    But maybe, we learned from our closest neighbors. The USA.
    Arlington Transit bus drivers were on strike for a second day on Tuesday, and they say they will be back on the picket line on Wednesday. It means major delays for riders, and it could be days or even weeks before service is back to normal.
    Or could it be we went a little further North. Oh Canada
    A nearly three-month old strike by public transportation workers in St. John’s has ended, with a large majority of union members voting Thursday evening to accept a tentative deal reached the day before.

    Whilst the reasons the strikes arent the same, we arent the only place on earth, where these things happen.

    But hey, i guess Bermuda is another world.

      its both the reason for the strike as well as the frequency of them for similar reasons.

      As soon as you mentioned the reasons for the strikes arent the same, you’re whole point became unrelated to this one. The reason for the strike is the entire thing that has people pissed off.

      I’m pretty sure that those examples you referenced aren’t a bunch of public transport drivers on strike to reinstate an employee who won’t take a drug test after having had an accident. They are striking for bigger issues – pay equity, working conditions etc. I mean, think about it, the whole Island grinds to a halt because of one druggie? Come on people. THINK!!!

    Can somebody answer me if there is a policy in transportation employees contracts stating that if they are in a accident they are subject to a drug test, or if there is a random drug test policy.
    If no such policy exists than the BIU is doing the correct thing for it’s member, no matter how childish it seems. Your employer cannot simply insist you take a drug test because it feels like it, they aren’t your probation officer or something. If there is no policy than the driver has every legal right to refuse to take one without reprocusion.
    If there is a drug test policy than the BIU is digging it’s own grave trying to defend this action.

      Yes. The policy exists. If a driver gets into an accident where a party is injured, he or she MUST submit to a drug test. The policy does not specify the type of drug test and, clearly, she was already offered the urine test immediately after the accident occurred. She declined and, thus, the efficacy period of a urine test had expired. The hair follicle test is the only one that is now viable. So, really, they are giving her yet ANOTHER chance to clear her name as the first time she declined, straight up insubordination. Breach of contract that SHE signed attributing to the fact that she would uphold the policy in place. She needs to be fired. Immediately and publicly.

    The point i was trying to make, is that people all over the world strike for many a reason, some valid and some not so.
    In this case, the BIU believes it has a valid point, because no such clause exists between the BIU and PTB, to have drivers drug tested via hair sample and no urine test.
    If the policy does exist, than the BIU is rowing up a creek without a paddle.
    The majority of the drivers do not support the driver in question, and if Mr. Furbert was a real leader, he would have the driver take a urine test and let the drivers get on with it.

      from what i’ve heard/read… the policies are in place. Supposedly the policy that after an accident you are immediately tested is in place, and supposedly random testing is in place. Someone mentioned (so hearsay at the moment) that there is no definition for what type of test shall be done…

      so according to that, BIU is doin that rowing that you were talking about… will be interesting to see how this end up.. im sure we all have our suspicions though.

      A urine test would be useless at this point because it would only indicate whether the driver currently has drugs in her system. By now, the only way to determine whether she had used drugs at the time of the accident would be to conduct a hair follicle test. Which she needs to do- I don’t want to be on the road with a bus driver who is operating his/her vehicle under the influence of drugs!!

    Just heard that many tourists from the cruise ships were stranded in Dockyard for quite a few hours today due to this “urgent meeting”. There were no taxis available, probably they were all in use by the lucky ones who hailed them first. Is this the message we want to get across to the visitors – that we welcome you here but once here you have to walk everywhere? People were picking the tourists up in cars and vans to get them to the beach etc.
    This is just plain stupid, any right thinking person wouldn’t do this to the struggling tourism industry … and where is the Minister, where does he stand, where is his statement? I know he is on the island at least a couple of days ago but he is strangely silent on this issue this time around. Bring on the next election, I’ve made my decision, I’m ready to exercise my right!

See the govt releases a statement saying that the PLP has no policy regarding the drug testing of MP’s….and then our beloved premier goes on to state that the call for MP’s to be drug tested is “politricks” and she sends a message to every govt employee getting high on the job that it’s OK to get high on the job.     Why the driver hasn’t been fired. According to the papers there is a clear policy that, if a driver is involved in an accident they have to report it and they have to take a drug test. This driver did neither. In any private company they’d have been immediately dismissed with cause. No appeal.
