Man Jailed For Ten Days For 2nd DUI Offense

January 23, 2013

In Magistrates Court yesterday [Jan 22], Aaron Crockwell, 29, pleaded guilty to driving whilst impaired and driving whilst disqualified. Senior Magistrate Archie Warner sentenced Crockwell to ten days in prison on each count, to run concurrent.

The Crown Prosecutor told the Magistrate that on the night of 19th January, in St George’s, Crockwell had ridden through an accident scene. Police stopped Crockwell and subsequently booked him for riding whilst impaired and riding whilst disqualified.

The Police breath test showed that Crockwell was more than two times over the limit. Additionally, Police checks uncovered the detail that Crockwell had been given a two year disqualification which ends in July 2013.

Crockwell explained to the Magistrate that he had been out that night and had been asked to take home a friend who was too drunk to ride or drive. Crockwell said that he “only had a few beers.”

Crockwell asked the Magistrate to punish him with a heavy fine and a longer disqualification. But Magistrate Warner noted that this was Crockwell’s second offence of riding whilst disqualified and that a longer disqualification would serve no purpose as disqualification orders were treated with contempt.

The Magistrate handed down the two ten day sentences.

I really wish the Magistrates on this island would replace the word ‘concurrent’ with ‘consecutive’.

Ummmm, what is the point of concurrent sentences? Time is time, is it not? The judicial system is in sad need of a shakeup starting with the magistrates. What are these people thinking?
