Court Appearance For Vodka Theft

39 years old and a self-confessed recovering drug addict, Devon Foggo first pleaded not guilty then changed his plea to guilty as he faced Magistrate Juan Wolffe in Magistrates Court this morning [Feb 24]. Initially, Mr Foggo was appearing because he had failed to comply with an earlier Court order requiring Court Services to provide a Social Inquiry Report on him.

Explaining that he had been sick on 4th February the date of his first appointment, couldn’t travel on 10th February because the buses were on strike, and had been grabbed by the Bailiffs and hauled off to Family Court on the 11th February; Mr Foggo said that he was now in Court to address the matter.

The Court Services Officer designated to deal with Mr Foggo agreed that he too had been out sick and asked if a new date for the production of a SIR could be agreed. Magistrate Wolffe set the matter down for 24th March 2011 when Foggo must appear for sentence and the SIR produced.

On a fresh count, Mr Foggo was charged with stealing a bottle of vodka valued at $50 from the Henry Vlll Pantry on South Shore Road in Southampton on the afternoon of 14th August 2010. Initially pleading Not Guilty, Mr Foggo changed his plea after he understood that this new charge could be dealt with at the same time as his earlier charges.

On changing his plea, Mr Foggo asked for leniency and understanding from the Court saying that he was man who was trying to “turn his life around” and had placed himself in the Methadone program. He said that he was trying to recover from an addiction to heroin.

Magistrate Wolffe agreed that the new matter could be bundled with his previous matters, could be included in the existing SIR and that new bail would be set, but that this new bail would amount to an extension of his previous $1,000 bail with a like surety.

Duty Counsel Edward King recommended that a BARC report seemed suitable, Magistrate Wollfe then ordered that a BARC report should also be prepared.
