Teens Sentenced To Time Served

Two 17-year-olds – Sanchea Douglas and Jaquii DeSilva – were freed today [Feb.16] after Senior Magistrate Archie Warner sentenced them to the 35 days that they had already spent in custody.

The two had pleaded guilty to charges involving affray and possession of offensive weapons during a fight outside Magistrate’s Court on 4th January 2012. Both had been remanded into custody until today.

The Senior Magistrate also ordered that they should be placed on Probation for two years with conditions for the teenagers including: No contact with any of the other two men involved in the affray; no association with persons engaging in illegal activity; ninety day curfew from 9:00pm until 6:00am; no consumption of any illegal drug or of alcohol; subject themselves to random urinalysis drug tests; and participate in any programs or activities deemed appropriate by the Department of Court Services.

The DPP’s Prosecutor had argued for a period of corrective training of between three and six months, and both defense lawyers argued for time already served. Magistrate Archie Warner said that he believed that a “short sharp shock” sometimes worked and that in this case, he believed that the short period of incarceration already served had been just that.

The two teens had been charged last month along with Trey Simons [18] and Deunte Darrell [19], who both pleaded not guilty. The Court heard that the four teenagers had been seen fighting outside the Court building.

When Police intervened, the four men had continued to engage with one another an Police reinforcements were needed to eventually stop the fight. The four were then taken to Hamilton Police Station where they were processed.
