Firearm/Burglary Charges: Burgess Not Guilty

[Updated] 17-year-old Leo Burgess was found not guilty of aggravated burglary and unlawful possession of firearm by a minor this afternoon [July 21], reported ZBM. Mr Burgess was found not guilty by a majority verdict of nine to three, after jurors deliberated for approximately four hours.

He stood trial in relation to an incident on December 6 last year, which saw Greg Wilson robbed in his South Road, Southampton home by four men, two of which were said to be wielding firearms – one of which the Crown had alleged was Mr Burgess. The men escaped with an estimated $65,000 of jewellery as well as cash.

During the trial an expert testified that DNA belonging to Mr Burgess was found on latex gloves and a red bandanna at the area where the crime took place. Mr Burgess said he had used the gloves to clean his bike, and left them outside a couple of days before the incident, and they were removed. Both Mr Burgess and his mother testified he was home sick the day of the incident, watching DVDs.

    What a disgrace for that jury to find Burgess not guilty.If their homes are broken into maybe they will be sorry they let him off. These young hoodlums get younger and younger and don’t even get a slap on the wrist. Lock them up before they kill someone next time

    clear evidence that the jury system does not work in bermuda. did they really believe that his DNA was found on the latex gloves because he used them to clean his football boots? and then he left them in a bag outside his house which someone stole to frame him? honestly, we deserve to be in the mess we’re in, because clearly some bermudians have no brains and/or no sense of justice.

    if u look closely you will see where DNA linked him to the scene and his mother is testifying that he was at home the entire night…had there been an eyewitness that could possibly place him at the scene he would have been in a predicament….if his mother is lying, she will have to live with that when someone runs up in her house and robs her place

    The problem is that he is a kid, and no one wants to put a child in jail. But I’m willing to bet that when this hoodlum is a little older and if he goes on to rob or kill one of the jurors relatives, they will really regret letting him off.

    He used gloves to clean his bike and left them outside? So someone was framing him? Give me a f*cking break!

      @NO YOU LOOK STUPID, your name says it all, and if we keep making excuses for these hoodlums they will continue to terrorize Bermuda. maybe it was not only HIS DNA found, but the fact of the matter is HIS DNA WAS found which proves he was there, so unless he says who the other culprits were he is [edited for legal reasons] and if you are his family member you need to steer him in the right direction not make excuses for him….

    Simple case. He lives next to Wilson, cleaned his bike using latex gloves and uses a red bandana to wipe it off. Goes inside, feels sick and momma makes chicken soup and he watches DVD’s. Four men enter the area and see the items and use them in the commission of a crime….Rubbing compound found on the bandana irritates one culprit and the gloves are hot and sticky so he takes em off and makes good his escape. Simple………….

    Betcha he lives on the ground floor…..you’ll get it…..

    - Think about his situation this way; “He gets arrested and locked up. He hasn’t really committed a crime, but because his DNA was found first on the evidence. He is the first person to suspect. The whole entire time he is doing time, he’s really doing it for his boys. Once he finds out what the real consequence/sentence is looking like. He’s saying to his self, it aint no way in hell i’m staying here for that long. So he starts speaking up and telling the police what really went down, he also starts giving out names. The police get all willy nilly because of the fact that they are able to prosecute more people, but before that wasnt really a priority, they were just happy that they atleast had one person. He finally is released because he actually is innocent. & now the police have four more people to chase after…

    How do you guys think this boy feels going back up to his neighborhood, & the friends he has might just turn their backs against them because he wanted to be free just like the rest of them. We all know the rate bermuda is going at right about now, so the least we can do is just hope that the police find the Real Culprits. Just because the police say they have a suspect and then his/her name is on the front page of Royal Gazette doesn’t mean they’ve actually committed the crime. So lets not get mad at the court system for letting him go home and be free, get mad at the fact that they aren’t digging deep enough to find out the real facts of whats going on…

    Like I said in another article…Do not give the BPS all this praise when they catch people….it’s becoming clearer and clearer the BPS are not thorough enough in their investigations…..the jury did an excellent job…the police failed!!…Again!!….Like their stop and searches…useless exercise!

        I’ve had my house broken into before and the cops on the scence didn’t know what to do…never took a statement, and then tell me the finger print unit doesn’t open till the next day….some officers don’t know basic protocol….I hope you weren’t their training officer….ooggghhh

            Actually I was a bit quick to rush to judgement but regarding statements, that is neither here nor there. Time, Place are the important factors. As for the finger print not opening till the next day, thats reasonable as long as you don’t touch, disturb annthing. If you feel violated by the Police after being violated by the culprit, a quick call and complaint would do the trick. Every case is differant and times are taxing.

            As for training officer, if I was they would be on the beat chasing trash trucks but then again thats not good use of personel. Have a great day and lock your windows. Only you can help prevent breakins…….

              Ok Terry, so let me make sure I understand . . . cause this was a real situation . . . I come home at 5pm to find my home has been burglarized and when the police come 2 hours later, they tell me the fingerprint unit is closed until the next day, just don’t touch anything!!!!! Uuumm my window is broken, I have kids and you don’t want me anything touched until the next day????????????? Are you really serious???????? How about we tell criminals to break in our homes when the fingerprint unit is open so they can get the finger prints during regular working hours . . . right???????

              As for this case, just like other cases the police work was sloppy as hell . . . CLEAN IT UP (in my gabrielle union voice) . . . CLEAN IT UP!!!!!!!!!!!!!!!

    He left latex gloves used to clean his bike outside and someone, somehow realised they were his gloves and it would be a good idea to remove them and frame him as well as with a bandana !!!???? How unbelievable. I feel for the man who’s house was robbed in a violent manner, these guys do what they want because they know they won’t ever be punished. The justice system is flawed, it needs to be reviewed by the present government.
