Top Runner Lamont Marshall Jailed For 6 Months

Lamont Marshall — one of the island’s top runners — was jailed for 6 months for his involvement in a collision that resulted in a woman being flown overseas for medical treatment.

He appeared in the Supreme Court today [Apr 3], after previously pleading guilty to causing injury by dangerous driving. Two people, Ian Scotton and Carley Lima, were injured in the collision, with Ms Lima suffering serious injuries which required her to be airlifted overseas.

The Crown recommended a 3 – 6 month custodial sentence, and the Judge handed down a 6 month prison sentence, followed by an 18 month driving disqualification.

Mr Marshall was originally charged last year in connection with the collision which occurred just past 1am on August 12 2012.

A police statement issued after the collision said that they responded to a report of a road traffic collision that took place at 1:09 at the junction of Middle Road in Paget and South Shore Road.

Police said that a man in car collided with a motorcycle that was traveling in the opposite direction. The cyclist and his pillion passenger were taken to the hospital where the man was treated for non life threatening injuries, while the female was in the ICU with serious head injures before being flown overseas.

At that time the police said the driver of the car, who they identified as a 28 year old Devonshire man, was arrested for suspicion of driving whilst impaired.

A prolific runner, Mr Marshall has set a number of Bermuda middle distance records including in the 3000, 5000 and 10000 meters.

    Not trying to minimize what has happened here but as I recall it a foreign worker here in Bermuda kills a school child getting off a bus on a crosswalk gets NOTHING and allowed to go home. But here we have this case…….

      Was the foreign worker drunk? Or merely made a poor driving decision? Let’s not act like we are comparing apples to apples.

        Doesn’t matter whether or not she was drunk. She was still obviously impaired that is why she could’nt stop her car. I agree with “Confused.” She gets to kill a child and run free, Mr. Marshall maims someone and goes to jail. Go figure! I still prefer dark apples.

          It does matter whether a person is drunk or not…and the woman wasnt impaired she did what every other road user does and over took a parked bus. She never saw the child step out from in front of the bus. He on the other hand was drunk, thats a huge difference between the two cases. She got off lightly for a bad decision but i certainly dont want a drunk driver get off just because she did.

        No problem, I will use the other incident. Remember when the young man struck the gentleman on South Shore, and the car burst into flames, and the gentleman died? The guy didn’t have a license and was drunk. If that were my blacka$$, i would be up West Gate as we speak!

          My mate Larry Thomas was killed by a fellow Bermudian outside 4 Star in Somerset and he got no punishment at all…and that was only about a year later after the same driver had taken out another person I know which did serious damage to his knee…both times he was drunk and both times he received no punishment for his decisions and actions

          The individual in question was a black Bermudian and his “blacka$$” got off on both occasions. So your race card is failing in this regard. Try again.

      an expat also killed a man and almost killed his sister in the car accident by swizzle, and he was just sent home to england, kinda puts into perspective the people who were calling for the tennis star to get life in prison. Not that any of it is right, but these are our laws

      This guys dad was fighting his azz off to keep him out of bootcamp for whatever immoral reasons known to men. Now he ends up in a much worse institution because of his own folly… I’m sure his dad will hear all about what goes on up first hand… He will surely grow up now…

    Please don’t try to compare the 2 incidents, as they have nothing in common.
    The female driver who are referring too, was NOT drunk and it is NOT against the LAW to overtake a BUS, maybe bad judgement on her behalf.

    The incident which probably closer to this, would be the BAC worker, whom crashed into another vehicle by Swizzle Inn, Warwick.

      you are exactly right you can’t compare the two events because they are very different. while the lady who struck and killed the little girl wasnt drunk she was on her cellphone and equally distracted and her not being drunk doesnt make it ok that she killed a beautiful little girl and walked away scott free. People we can’t pick bones out of each situattion wrong is wrong all three persons involved in all three accidents displayed poor judgement. The real issue that should be focused on is the punishments that have been handed down to the persons involved the clear differences are deplorable. The facts of the matter are 2 people died and the people responsible received a slap on the wrist and 1 young lady survied and the person responsible for that received jail time.

        equally distracted as drunk driver? talking on a cellphone wasnt illegal then, although she should have gotten a bigger punishment for a bad driving decision, the death of the young girl wasnt the result of a criminal offense. Thats the difference between being given a custodial sentence or not.

        the death of the young girl wasnt from a criminal offence such as drunk driving, that has alot to do with wether you get jail time or not. Driving drunk is a criminal offence.

    The article states that he was arrested under suspicion of driving whilst he was impaired, and there is no further clarification. Doesn’t really matter if he killed someone or just injured them, if he was drunk or had taken drugs, getting behind a wheel is stupid. It’s not rocket science. Too many people here in Bermuda that are drinking and driving (whether rich or poor, black or white – everyone’s doing it).

    Why is the sentence so lenient?

    I can recall a couple of years ago a woman sent to prison for two years, after she hit a cyclist and injured him. The cyclyst’s injuries were not as serious as the two victims in this case. Yet she got two years. This person ruined two lives. He should not have been treated so leniently.

      actually that guy was a high school kid and was in ICU and then therapy for months, so his injuries were very serious

    Unfortunately people have been killed innocently not just in Bermuda but all over the world, some due to accidents.
    Every case has to be looked at on its own merit and the facts weighed.
    Whilst I can agree that the loss of life, is something that no-one should be able to take from another, Do you believe it was the female driver intent?
    I also noted another commenter stated about the driver being on a cellphone, whilst if my memory serves me correct, that wasn’t against the law when this tragic accident happened. Just like to this day, people continue to overtake buses, when stopped for passengers.
    How many people have you seen eating, drinking or even putting on makeup when driving on Bermuda’a roads?
    The point of this article, was that Mr. Marshall admitted to having a drinking problem, and his actions could have cost 3 lives, including his own to be snuffed out.

      it was not illegal then…I bet you still talking on ya cellphone while driving now and overtake buses just like most other road users, so have you learned anything from that unfortunate accident. Keep in mind it was the jury who cleared her.

      Dont forget the bus was stopped behind the zebra crossing with its hazard lights on. THats means as we all know that someone is about to cross on the crossing. Pure neglegence on the drivers part. We really need to update or implement our neglegance and tort laws in order to properly fine or imprison these people.

    my thing is this I dont have nothing for people who go out drinking & than have the nerve to drive, they dont have no heart, I can say that as I lost my one & only son through this & i have to live with his lost for the rest of my days & yes I did forgive the driver of the car to which is my son’s cousin. but I say this his cousin will never be the same. Yet I still don’t have no MERCY for people who drink & drive.I am living with his lost & it’s made my life a living hell, but I thank GOD for seeing me throug each & every day, & yes you can FORGIVE BU NEVER FORGET, MY LIFE IS GOING ON WITH HEARTACHES BUT I WILL SURVIVE. HAVE A BLESSED DAY ALL.

    It is incorrect to focus solely on the outcome of an accident. One must take into account the circumstances surrounding the accident. No alcohol was involved and the driver was driving within the bounds of the law. Certainly a tragedy, but totally different from this case.

    These 2 got 12 months and 15 months jail time respectively. A good question would be: Why is Lamont’s jail time so short?

    I do believe that Lamont is serving time for regiment objection rather than the accident. I just pray that he is safe in there.

    @Markus… My statement was to point out the prosecution and judges of the day are not being consistent with their rulings. Either we are hard on the drunk driving, or death by due care or we are not. Period. One is NOT better than the other.

    Bottom line. Until people start making better decisions then we will see change. Look at the amount of people who still continue to walk, run, cycle the streets of Bermuda in dark or black clothing with little or no lights or reflective gear.
    Bottom Line. Until Bermudians (residents) are REALLY ready to be serious about drinking and driving this will not be the last case like this. TOO MANY PEOPLE drink, drive or are letting people drink and drive. When we get serious about that then there will be change.
