Court: Threatening Words Case Dismissed

In Plea Court earlier this week, 54-year-old taxi-driver Hyman Bartley avoided two legal problems when lawyer Charles Richardson noted a legal point and raised it to Senior Magistrate Archie Warner.

Bartley was facing two counts of threatening words to a Traffic Warden. The two charges stemmed from incidents alleged to have occurred in June 2011.

When the charges were read to Mr Bartley, lawyer Charles Richardson, who was attending Court on another matter, quickly consulted the law books and the rose to raise a matter to the Senior Magistrate.

Mr Richardson intervened and advised the Magistrate that the alleged offence was a Summary offence that needed to be brought before the Court within six months of its alleged occurrence, and that this action was being brought in February , eight months after and two months outside the last actionable date.

After going through the legal formality of the DPP placing the charge and the charge being read to Mr Bartley; Mr Richardson then formally raised the legal objection on Mr Bartley’s behalf. The Senior Magistrate accepted the objection and ruled that the charges could not be proceeded with.

The Magistrate then dismissed the eight month old charges against Mr Bartley.
