Man Gets Probation For Cell Phone Theft

After being convicted of stealing $2,137 worth of cellphones from his employer CellOne earlier this year, Jahmarley Gardiner, 25, was before Senior Magistrate Archie Warner this morning for sentencing.

In the course of sentencing Mr Gardiner, the Senior Magistrate was considering a restitution order. However, the Probation Officer who had prepared the Social Inquiry Report [SIR] on Mr Gardiner told the Senior Magistrate that the Management of CellOne were not seeking restitution of value.

The Officer told the Magistrate that he had spoken to CellOne that morning and that the CellOne Management response was that in their view, Mr Gardiner — who had lost his job at CellOne and was now unemployed — had already been punished enough.

The Magistrate went on to impose a sentence of two year’s probation, saying  he took into account Mr Gardiner’s previously clean record, that the SIR had said that the offences appeared to be lapses of judgment, and that there was a low risk of Mr Gardiner re-offending.

      He stole from his employer. That might affect his future employment opportunities. He’s going to have to live with that.
